Pavement Warranties - GuidanceSince 1995, warranties have taken a more dominant position in the Federal-aid Highway Program across the country. Some States have not tried warranties for legislative or institutional reasons. Other States have legislative mandates requiring warranties, and along with States that have tried warranties for engineering reasons, are reporting a range of experiences. Current requirements for warranties are contained in 23 CFR 635.413. To expand the use of pavement warranties FHWA is providing detailed guidance for the States, to develop and to manage warranties. FHWA is interested in advancing performance warranties for Hot Mix Asphalt, Portland Cement Concrete, as well as a variety of preservation applications such as micro-surfacing. The following three documents have been prepared based on the successful use of pavement warranties by State agencies.
In addition, FHWA is preparing an introductory workshop based on the guidance documents to discuss various considerations that should be addressed in all warranty programs, independent of the source of funding or routes. The workshop is not intended to re-write State specifications, rather to provide examples of what has worked well in similar situations, for the State to consider.
