TITLE: Memorandum of Agreement between the Bureau of Indian Affairs and the Federal Highway Administration
SUBJECT: Federal Lands Highways Program (Indian Reservation Roads)

PURPOSE OF THE AGREEMENT: Implements the Federal Lands Highways Program (FLHP) for Indian Reservation Roads (IRR) as required by the STAA of 1982. FLHP provides engineering assistance. Federal-aid Divisions assist in reviewing and approving PS&E's developed by BIA. Amendment 1 implemented ISTEA provisions 23 USA 144(c)(3)[bridge inspection and rating] and 144(g)(4). The 23 USC 144(g)(4) was in TEA-21. This MOU is to be revised after negotiated regulations for IRR program is completed in FY 2000.

FINANCIAL REQUIREMENTS: FHWA transfers of obligationsl (contract) authority and liquidating cash to BIA for projects for which it has program responsibility. For all non-FLHP projects which will be funded with BIA appropriations, obligational authority and liquidating cash will be transferred to FHWA (this is rare because BIA generally has not received DOI appropriated construction funds since 1983.
