Attached is the revised Procedures Manual for Processing Extemal Complaints of Discrimination. The procedures provide guidance for processing extemal complaints of discrimination filed under Title VI of the Civil Rights Act of 1964 (Title VI) and the Americans with Disabilities Act of 1990 (ADA) and outline the responsibilities of the Headquarters Office of Civil Rights (HCR), the Division offices, and the State Transportation Agencies (STA) for the process. The revised manual includes guidance from the Department of Justice, more in-depth information on the investigative process, the theories of discrimination, and Title VI and the ADA.

The procedures in the revised manual reinforce the understanding that all final decisions for all complaints are issued by the HCR regardless of whether the Division office or the STA conducts the investigation. The revised manual will continue to provide guidance for ensuring that complaint processing within FHWA is a uniform and reliable process. These procedures can be distributed to and used by the STAs.
