
The Transportation Infrastructure Finance and Innovation Act of 1998 (TIFIA) was originally authorized under the Transportation Equity Act for the 21st Century (TEA-21). TIFIA was reauthorized and amended in 2005 by the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). This section of the TIFIA website includes relevant excerpts of the TEA-21 authorizing legislation and accompanying technical corrections as well as relevant legislative excerpts from SAFETEA-LU. It should be noted that SAFETEA-LU's reauthorization of TIFIA resulted in a renumbering of its sections within Title 23 of the U.S. Code from §§ 181-189 to §§ 601-609.
The USDOT published its rules for the TIFIA program in the Code of Federal Regulations (49 CFR 80) one year after the passage of TEA-21 in June 1999 and revised them in July 2000. Public notices for these acts of rulemaking are provided under Federal Register Notices, along with other announcements related to the TIFIA program. The TIFIA regulations have not been updated to reflect changes enacted in Public Law 109-59, SAFETEA-LU. Where the statute and the regulation conflict, the statute takes precedence. The U.S. Department of Transportation (USDOT) Transportation Infrastructure Finance and Innovation Act (TIFIA) Joint Program Office (JPO) announces the availability of a limited amount of funding in fiscal year 2012 to provide credit assistance. Because demand for the TIFIA program exceeds budgetary resources, the DOT is utilizing periodic fixed-date solicitations that will establish a competitive group of projects to be evaluated against the program objectives. The Notice of Funding Availability (NOFA), published November 3, 2011, outlines the process that applicants must follow for consideration in this funding cycle. Letters of Interest must be submitted by 4:30 p.m. EST on December 30, 2011, using the revised form in the Guidance and Applications section. Submit all Letters of Interest to the attention of Mr. Duane Callender via e-mail at: TIFIACredit@dot.gov.
