FEDERAL-AID POLICY GUIDE - CHANGE

  1. PURPOSE. To transmit new and revised pages to the Federal-Aid Policy Guide (FAPG).

  2. BACKGROUND. This is the second transmittal incorporating into the FAPG Federal-aid policies and procedures previously issued in non-directive format (e.g., memorandums).

  3. COMMENTS

    1. Current non-regulatory guidance material, which was previously issued in non-directive format, is being incorporated into the FAPG as follows:

        (1) NS 23 CFR 140G is established to incorporate relevant provisions of the following memorandums:

          (a) Reimbursement for State Employee Training Costs on Federal-Aid Projects dated August 18, 1988, signed by the Associate Administrator for Administration; and

          (b) Reimbursement for State Employee Training Costs on Federal-Aid Projects dated April 27, 1989, signed by the Assistant Chief Counsel for General Law.

        (2) NS 23 CFR 230C is revised to incorporate relevant provisions of the following memorandums:

          (a) State Highway Agency (SHA) EEO Programs dated April 17, 1979, signed by the Federal Highway Administrator;

          (b) State Highway Agency (SHA) Goals and Timetables for Minority and Female Employment, Training and Promotion dated April 26, 1983, signed by the Director,Office of Civil Rights;

          (c) Submission of EEO-4 Reports dated September 12, 1983, signed by the Director, Office of Civil Rights;

          (d) Contract Compliance--Reviews of State Contract Compliance Programs dated May 26, 1983, signed by the Director, Office of Civil Rights; and

          (e) EEOC Policy Guidance on Title VII and Age Discrimination Employment Act (ADEA) Application to Part-Time Employees dated August 22, 1990, signed by the Director, Office of Civil Rights.

        (3) NS 23 CFR 230D is established to incorporate relevant provisions of the following memorandums:

          (a) Contract Compliance - FHWA and State Enforcement of OFCCP Required Goals and Time-tables in Contracts dated November 6, 1990, signed by the Director, Office of Civil Rights;

          (b) Office of Federal Contract Compliance Programs (OFCCP) Reporting Requirements 41 CFR 60-4.2 dated August 29, 1986, signed by the Director, Office of Civil Rights;

          (c) Office of Federal Contract Compliance Programs (OFCCP) Construction Contractors' Affirmative Action Requirements dated February 24, 1981, signed by the Director, Office of Civil Rights;

          (d) Clarification of Contract Compliance Responsibilities dated December 11, 1980, signed by the Director, Office of Civil Rights;

          (e) EEO Compliance Determinations Made Under the Authority of Executive Order 11246, as Amended dated October 24, 1986, signed by the Director, Office of Civil Rights; and

          (f) Section 122, Surface Transportation and Uniform Relocation Assistance Act of 1987--Indian Employment Preference dated October 6, 1987, signed by the Federal Highway Administrator.

        (4) NS 23 CFR 420A is revised to incorporate relevant provisions of the following memorandums:

          (a) Field Office Reporting of Motor Fuel Data dated February 4, 1991, signed by the Director, Office of Highway Information Management; and

          (b) Highway Performance Monitoring System (HPMS) Region and Division Office Action to Verify Accuracy Data dated June 21, 1988, signed by the Executive Director.

        (5) NS 23 CFR 470A is revised to incorporate relevant provisions of the following memorandum: Criteria for Interstate Additions, 23 U.S.C. 139(a) and (b) dated June 3, 1986, signed by the Associate Administrator for Engineering and Program Development.

        (6) NS 23 CFR 625 is established to incorporate relevant provisions of the following memorandum: Prestressing Strand for Pretension Applications -Development Length Revisited dated October 26, 1988, signed by the Chief, Bridge Division, Office of Engineering.

        (7) NS 23 CFR 633B is revised to incorporate relevant provisions of the following memorandum: Appalachian Highway Program dated June 26, 1979, signed by the Executive Director.

        (8) NS 23 CFR 650A is established to incorporate relevant provisions of the following memorandums:

          (a) Proration of Costs for Storm Drainage Installation dated September 11, 1962, signed by the Director of Engineering;

          (b) Proration of Costs for Storm Drainage Installation dated September 7, 1962, signed by the Director of Engineering;

          (c) Cast-In-Place Non-Reinforced Concrete Pipe dated December 12, 1983, signed by the Chief, Bridge Division, Office of Engineering;

          (d) Location and Hydraulic Design of Encroachments on Flood Plains, FHPM 6-7-3-2, Paragraph 9 - Design Standards dated May 18, 1983, signed by the Executive Director;

          (e) Backwater Criterion for Hydraulic Design of Structures dated April 21, 1992, signed by the Associate Administrator for Program Development;

          (f) Design Standards for Highways in National Flood Insurance Program Mapped Floodplains dated April 2, 1986, signed by the Associate Administrator for Engineering and Program Development; and

        (9) NS 23 CFR 650C is revised to incorporate relevant provisions of the following memorandums:

          (a) Annual Maintenance Monitoring Program; National Bridge Inspection Standards Report Format dated April 4, 1990, signed by the Associate Administrator for Engineering and Program Development;

          (b) National Bridge Inspection Standards (NBIS) Follow-up Actions on Critical Recommendations by Bridge Inspection Teams dated January 11, 1989, signed by the Director, Office of Engineering;

          (c) Compliance with the National Bridge Inspection Standards - Underwater Inspection and Bridge Scour dated November 18, 1988, signed by the Director, Office of Engineering;

          (b) Discretionary Bridge Program Allocation Considerations dated September 24, 1986, signed by the Executive Director; and

          (c) Discretionary Bridge Allocations - Transfer of Funds for Project Phases dated October 9, 1984, signed by the Director, Office of Engineering.

        (12) NS 23 CFR 655A is established to incorporate relevant provisions of the following memorandums:

          (a) Traffic Management Activities During Major Highway Reconstruction dated December 19, 1986, signed by the Associate Administrator for Safety and Operations and the Associate Administrator for Engineering and Program Development; and

          (b) Federal-aid Participation in Traffic Management Improvements in Urban Areas dated April 20, 1989, signed by the Director, Office of Traffic Operations.

        (13) NS 23 CFR 655D is established to incorporate relevant provisions of the following memorandum: Eligibility of Police Enforcement and Surveillance Activities in Traffic Management During Major Highway Reconstruction dated October 1, 1987, signed by the Associate Administrator for Safety and Operations and the Associate Administrator for Engineering and Program Development.

        (14) NS 23 CFR 656 is established to incorporate relevant provisions of the following memorandum: Carpool and Vanpool Projects dated January 25, 1983, signed by the Chief, Urban Planning and Transportation Management Division.

        (15) NS 23 CFR 658 is established to incorporate relevant provisions of the following memorandums:

          (a) National Network for Trucks - Nebraska and Iowa dated December 7, 1987, signed by the Director, Office of Planning;

          (b) Interpretation of Vehicle Length Provisions dated November 2, 1988, signed by the Director, Office of Motor Carrier Information Management and Analysis;

          (c) Truck Access - Vehicle Weight dated March 6, 1991, signed by the Director, Office of Motor Carrier Information Management and Analysis and the Director, Office of Environment and Planning; and

          (d) State Reasonable Access Provisions dated April 3, 1991, signed by the Director, Office of Environment and Planning.

        (16) NS 23 CFR 669 is revised to incorporate relevant provisions of the following memorandum: Certification of Enforcement - Proof of Payment of Heavy Vehicle Use Tax dated October 29, 1991, signed by the Director, Office of Highway Information Management.

        (17) NS 23 CFR 810A is established to incorporate relevant provisions of the following memorandum: High Occupancy Vehicle (HOV) Facilities dated October 4, 1990, signed by the Federal Highway Administrator.

    2. The non-directive issuances listed in paragraph 3a are canceled. Additional Federal-aid polices and procedures issued in non-directive format will be incorporated into the FAPG in the near future.

  4. REGULATORY MATERIAL. The pages transmitted by this change contain no regulatory material.

  5. ACTION. Each recipient office is responsible for filing the attached FAPG pages into the binders provided.
