  1. What is the purpose of this update? This transmittal updates the Federal-Aid Policy Guide (FAPG), to include several regulatory changes that were previously published in the Federal Register.

  2. What are the changes? The changes to the FAPG are as follows:
    1. 23 CFR Part 1.11(a), Engineering Services, removes the last sentence.

    2. 23 CFR Part 140, Reimbursement, includes authority changes and removal of Subpart G.

    3. 23 CFR Part 180, Credit Assistance for Surface Transportation Projects, is added.

    4. 23 CFR Part 630, Preconstruction Procedures, includes authority changes, revisions and edits in Subpart A and removal of Subpart C.

    5. 23 CFR Part 645, Utilities, includes revisions and edits in Subparts A and B.

    6. 23 CFR Part 655, Traffic Operations, includes a revision in Subpart F to reference the 2000 Millennium Edition of the Manual on Uniform Traffic Control Devices and removal of Subpart D.

    7. 23 CFR Part 661, Indian Reservation Road Bridge Program, is added.

    8. 23 CFR Part 668, Emergency Relief Program, includes revisions and edits in Subpart A.

    9. 23 CFR Part 777, Mitigation of Impacts to Wetlands and Natural Habitat, is extensively revised.

    10. 23 CFR Part 940, Intelligent Transportation System Architecture and Standards, is added.

    11. 23 CFR Part 1210, Operation of Motor Vehicles by Intoxicated Minors, is added.

    12. 23 CFR Part 1225, Operation of Motor Vehicles by Intoxicated Persons, is added.

    13. 23 CFR Part 1240, Safety Incentive Grants for Use of Seat Belts-Allocations Based on State Seat Belt Use Rates, is added.

    14. 23 CFR Part 1270, Open Container Laws, is added.

    15. 23 CFR Part 1275, Repeat Intoxicated Driver Laws, is added.

  3. Will these changes be codified? The regulatory material in this directive has been published in the Federal Register and has been codified in Title 23, Code of Federal Regulations.
