APPORTIONMENT OF FISCAL YEAR (FY) 1996 RESTORATION FUNDS PURSUANT TO PUBLIC LAW 104-

  1. PURPOSE. To transmit the certificate of apportionment of the Restoration funds pursuant to Section 202 of Public Law (P.L.) 104- , National Highway System Designation Act of 1995. The apportionment is effective immediately.

  2. AVAILABILITY

    1. The funds resulting from this apportionment are subject to lapse on September 30, 1999, if they have not been obligated for projects.

    2. The funds may be obligated for projects eligible for assistance under Chapter 1 of Title 23, United States Code.

    3. The funds resulting from this apportionment are available for obligation immediately and will be subject to obligation controls in force at the time of obligation.

    4. Each State may expend 1/2 of 1 percent of the funds resulting from this apportionment for carrying out the provisions Section 134 of Title 23, United States Code (relating to transportation planning). Each State may also expend 1 1/2 percent of such funds to carry out activities under Section 307(c) of such title.

    5. Supplementary tables providing the appropriation codes and suballocation of these funds will be issued in a separate memorandum.

  3. ACTION. Division Administrators should ensure that copies of this Notice are furnished to State highway agencies.

The Secretary of the Treasury of the United States, the Secretary of the Interior, the Governors of the States, the Mayor of the District of Columbia, the Governor of the Commonwealth of Puerto Rico, the Governor of the Virgin Islands, the Governor of American Samoa, the Governor of Guam, and the Governor of the Commonwealth of the Northern Mariana Islands.

Pursuant to section 202 of the National Highway System Designation Act of 1995, P.L. 104- , and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator, section 1.48 of title 49, Code of Federal Regulations, I hereby certify--

First, that the Secretary of the Treasury has made the estimates required by section 9503(d) of the Internal Revenue Code of 1986 and based upon such estimates, and in compliance with section 202 of the National Highway System Designation Act of 1995, I have computed the apportionment for the purpose of carrying out that section in the manner provided by law and in accordance with the allocation formula in section 202(b) of the National Highway System Designation Act of 1995, and I have determined that the amount which can be apportioned for funding restoration under this section is $266,522,436 which is 100 per centum of the amount authorized to be appropriated for this program for the fiscal year ending September 30, 1996.

Second, that the sum which are hereby apportioned to each State, the District of Columbia, the Commonwealth of Puerto Rico, and the Territories effective immediately are respectively as follows:
