APPORTIONMENT OF FISCAL YEAR (FY) 1996 HIGHWAY SAFETY PROGRAM - SECTION 402

  1. PURPOSE. To transmit the certificate of apportionment of the $11 million of funds authorized for FY 1996 pursuant to the Department of Transportation and Related Agencies Appropriations Act of 1996 (Public Law 104-50), to carry out Section 402 of Title 23, United States Code (relating to highway safety programs), by the Federal Highway Administration. The apportionment is effective immediately.

  2. AVAILABILITY

    1. The funds resulting from this apportionment are available for obligation effective immediately and are subject to obligation controls in force at the time of obligation.

    2. The funds resulting from this apportionment are subject to lapse on September 30, 1999, if they have not been obligated.

  3. ACTION. Division Administrators should ensure that copies of this Notice are furnished to Governor's Highway Safety Representatives and to State highway agencies.

FEDERAL HIGHWAY ADMINISTRATION
FOR THE FISCAL YEAR ENDING
SEPTEMBER 30, 1996

The Secretary of the Treasury of the United States, the Secretary of the Interior, the Governors of the States, the Mayor of the District of Columbia, the Governor of the Commonwealth of Puerto Rico, the Governor of the Virgin Islands, the Governor of American Samoa, the Governor of Guam, and the Governor of the Commonwealth of the Northern Mariana Islands.

Pursuant to 23 U.S.C. 402, the Intermodal Surface Transportation Efficiency Act of 1991, the Department of Transportation and Related Agencies Appropriations Act of 1996 and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator, section 1.48 of title 49, Code of Federal Regulations, I hereby certify--

First, that the Secretary of the Treasury has made the estimates required by section 9503(d) of the Internal Revenue Code of 1986 and based on such estimates, I have determined that the amount which can be apportioned for highway safety programs administered by the Federal Highway Administration for the fiscal year ending September 30, 1996, is $11,000,000 which is 100 percent of the amount authorized to be appropriated for such highway safety programs for that fiscal year by the Department of Transportation and Related Agencies Appropriations Act of 1996.

Second, that in accordance with the Department of Transportation and Related Agencies Appropriations Act of 1996, I have deducted $100,000 for administering the provisions of section 402(c) of title 23, United States Code, from the sum of $11,000,000 authorized to be appropriated for the fiscal year ending September 30, 1996.

Third, that after making the said deduction, I have computed the apportionment of the remainder of the sum of $10,900,000 authorized to be appropriated for the fiscal year ending September 30, 1996, among the States as defined for this purpose in sections 401 and 402(i) of title 23, United States Code, in a manner provided by law and in accordance with the formula set forth in section 402(c) of title 23, United States Code.

Fourth, that the sums which are hereby apportioned to each State effective immediately are respectively as follows:
