FEDERAL PROCUREMENT DEBARMENT AND
NONPROCUREMENT DEBARMENT

  1. PURPOSE. To advise that debarment actions have been taken as set forth below under both the Federal Acquisition Regulations (FAR) for direct Federal procurements and the U.S. Department of Transportation's debarment regulations for federally-assisted programs.

  2. CANCELLATION. Notice N 2000.446, Federal Procurement Suspension and Proposed Debarment and Nonprocurement Suspension and Proposed Debarment, dated March 18, 1993, is hereby canceled.

  3. ACTION TAKEN

    1. The individuals and company cited below have been debarred from participating in any future Federal Government constracting and government-approved subcontracting beginning March 18, 1993, and ending on the expiration dated listed below. They have also been debarred from participating in any programs or projects receiving Federal financial assistance from any agency of the Executive Branch of the Federal Government, including contracts, beginning March 18, 1993, and ending on the expiration dates listed below.

    2. On Federal procurements, the individuals and company cited above shall be prohibited from participation as a contractor or subcontractor and from performing services in such programs or contracts while under this debarment. In addition, pursuant to FAR § 9.406-5(b), at the Government's descretion, any firm or individual affiliated with which the individuals and company cited above shall be prohibited from participation as a contractor or subcontractor and from performing services to any contractor in such programs or contracts during the term of this debarment.

    3. On Federal financial assistance, the individuals and company cited above shall be prohibited from participation as a contractor or subcontractor in such programs while under this debarment. In addition, any firm or individual affiliated with the individuals and company cited above shall be prohibited from participating as a contractor or subcontractor in such programs during the term of this debarment.

    4. On February 12, 1991, Anthony Bucci and Asphalt Specialists, Inc., were convicted in U.S. District Court for the Northern District of Ohio, Eastern Division, of several counts each of violating 18 U.S.C. §§ 287, 1340, and 1341. On April 22, 1992, a conviction was entered against Robert T. Bucci was convicted in the same forum for a violation of 18 U.S.C. § 1003. On July 10, 1992, Anthony R. Bucci and Asphalt Specialists, Inc., were convicted in the same forum of conspiracy in violation of 18 U.S.C. § 371 and false statements in violation of 18 U.S.C. § 1020(2) in correcting with the non-payment of Davis-Bacon wages on Federal-aid Highway Projects.

    5. Federal Highway Administration's (FHWA) officials, including the debarring offical, met with representatives of the individuals and the company. Mitigating information has been presented to the FHWA and considered in this action. The proposed debarment period of three (3) years for the individuals has been reduced to six (6) months for Anthony R. Bucci and eighteen (18) months for Anthony R. Bucci. Mitigation of the proposed debarment period of three (3) years for the company was not considered because no mitigating information was presented on its behalf.

    6. These debarment actions are taken in accordance with all applicable laws and regulations, including 58 CFR Subpart 9.4 and 49 CFR Part 29 (1990).
