What is the purpose of this Notice? This Notice cancels Federal Highway Administration (FHWA) Notice N2000.570, and it serves to advise that the FHWA has made a decision concerning the proposed debarments of the following company and individual as stated in paragraph 2a.

What actions have been taken?
The FHWA has decided to debar the company and individual cited above retroactive from the date of their suspensions for a period of 3 years; DEBARMENTS EXPIRE: August 2, 2009.
The company and individual cited above have been notified in writing of this decision.
What is the scope of these actions? The company and individual cited in paragraph 1 are prohibited from being a participant or principal in any covered transaction as described in 49 CFR Part 29, Subpart B. Generally, the company and individual are prohibited from submitting a proposal for, or entering into, a covered transaction, or participating in a covered transaction as an officer, director, owner, partner, key employee, or other person with primary management or supervisory responsibilities, or one who has critical influence on or substantive control over the transaction, whether employed by a person who submits a proposal for, or enters into a covered transaction, including any procurement and nonprocurement transaction between an agency and a person. These debarments are effective throughout the Executive Branch of the Federal Government.
What are the causes for these debarments?
On April 27, 2006, Carmel Concrete Products and Scott D. Hughey pled guilty to violating Section 1 of the Sherman Act, 15 U.S.C. 1. Specifically, both parties pled guilty to a one-count information that charged them with participating in a conspiracy to suppress and eliminate competition by fixing the price at which ready mixed concrete was sold in the Indianapolis, Indiana, metropolitan area beginning in or about July 2000 and continuing until May 25, 2004.
Pursuant to 49 CFR Part 29, Carmel Concrete Products and Scott D. Hughey have committed acts that are cause for debarment. Specifically, the FHWA believes that their guilty pleas constitute sufficient cause for debarment.
After considering the serious nature of these acts, the FHWA has decided that Carmel Concrete Products and Scott D. Hughey pose a risk to the Federal Government and that it is in the best interest of the Federal Government that they be debarred for a period of 3 years. As stated above, these debarments will expire on August 2, 2009.
These debarments have been taken in accordance with 49 CFR Part 29.
