  1. What are the purposes of this Notice?

    1. This Notice serves to advise that the Federal Highway Administration (FHWA) has made a decision concerning the suspension and proposed debarment of the company listed below as stated in paragraph 2.

    2. This Notice, along with FHWA Notices N 2000.579 and N 2000.580, cancel FHWA Notice N 2000.544, issued on September 16, 2005.

  2. What actions have been taken?

    1. On November 21, 2005, Irving Materials, Inc., submitted a proposed agreement outlining a plan that would correct the conditions that led up to its August 22, 2005, suspension and proposed debarment. Specifically, to ensure that it was responsible to engage in Federal Government contracts, the plan indicated that the company would contract an independent reviewer to monitor its activities for a 3 year period beginning August 22, 2005. The independent reviewer would report only to FHWA and would be subject only to FHWA's control and direction. The plan also included measures to discipline the individuals who were involved in the alleged misconduct and to eliminate their involvement in the company's management. Specifically, the individuals would be removed from management positions in the company.

    2. After review and agreement by all parties to the terms of the proposed agreement, FHWA decided to lift the suspension of Irving Materials, Inc. The suspension of Irving Materials, Inc., was lifted on January 18, 2006.

    3. This decision has been made in accordance with 49 CFR Part 29.
