  1. What is the purpose of this Notice?

    1. This Notice serves to advise that the Federal Highway Administration (FHWA) has made a decision concerning the suspension of the individual named below as stated in paragraph 2.

    2. This Notice, along with FHWA Notices N 2000.608, N 2000.609, and N 2000.610, cancel FHWA N 2000.548, issued on April 6, 2006.

  2. What action has been taken?

    1. In a letter dated April 7, 2006, John Marchese contested FHWA's March 10, 2006, suspension action.

    2. After considering all of the relevant information submitted, FHWA determined that John Marchese did not appear to meet the definition of a principal as defined by 49 CFR 29.995. Therefore, the suspension was terminated on July 24, 2006.

    3. This decision has been made in accordance with 49 CFR Part 29.
