NOTICE

AMENDED APPORTIONMENT OF HIGHWAY
SAFETY PROGRAM FUNDS AUTHORIZED FOR
FISCAL YEAR (FY) 1990 - SECTION 402

January 11, 1990

  1. PURPOSE. To transmit an amended certificate of apportionment of the $10 million of funds authorized for FY 1990 pursuant to the Surface Transportation and Uniform Relocation Assistance Act of 1987 (P.L. 100-17), to carry out Section 402 of Title 23, United States Code (relating to highway safety programs), by the Federal Highway Administration.

  2. CANCELLATION. FHWA Notice N 4510.246 dated November 13, 1989, is cancelled due to the cancellation of the October 16, 1989, sequestration.

  3. BACKGROUND. Pursuant to a Presidential Order, dated December 27, 1989, as required by the Omnibus Budget Reconciliation Act of 1989 (P.L. 101-239), $140,000 in budget authority for the Section 402 program authorized for FY 1990 has been sequestered.

  4. AMENDMENT. FHWA Notice N 4510.243, dated September 29, 1989, is amended to reflect the reduction in apportionment as required by the President's Order.

  5. ACTION. Division Administrators should ensure that copies of this Notice are furnished to Governor's Highway Safety Representatives and to State highway agencies.

FOR THE FISCAL YEAR ENDING

The Secretary of the Treasury of the United States, the Secretary of the Interior, the Governors of the States, the Mayor of the District of Columbia, the Governor of the Commonwealth of Puerto Rico, the Governor of the Virgin Islands, the Governor of American Samoa, the Governor of Guam, and the Governor of the Commonwealth of the Northern Mariana Islands.

Pursuant to 23 U.S.C. 402, the Federal-Aid Highway Act of 1987, the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, the Omnibus Budget Reconciliation Act of 1989, and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator, section 1.48 of title 49, Code of Federal Regulations, I hereby certify--

First, the pursuant to the Omnibus Budget Reconciliation Act of 1989, the $530,000 cancellation in budget authority cancelled pursuant to the Balanced Budget and Emergency Deficit Control Act of 1985 by a Presidential Order dated October 16, 1989 and referred to in an apportionment certificate attached to FHWA Notice N4510.246 dated

November 13, 1989, which apportionment certificate is incorporated by reference, has been rescinded and replaced by a cancellation of $140,000.

Second, that such $140,000 cancellation in budget authority was apportioned on October 1, 1989 by an apportionment certificate attached to FHWA Notice N4510.243, which apportionment certificate is incorporated by reference.

Third, that the apportionment certificate attached to FHWA Notice N4510.246 dated November 13, 1989 is rescinded.

Fourth, that the deduction in the apportionment certificate attached to FHWA Notice N4510.243 is amended and reduced to reflect the $140,000 cancellation of budget authority.

Fifth, that subject to the deduction and the $140,000 cancellation, the apportionments available pursuant to such amended apportionment certificate are respectively as follows: [SEE PRINTED COPY OF NOTICE FOR SUMS]
