NOTICE

AMENDED APPORTIONMENT OF THE FISCAL YEAR
(FY) 1993 APPORTIONMENT ADJUSTMENT FUNDS

  1. PURPOSE. To transmit an amended certificate of apportionment for the Apportionment Adjustment funds authorized for FY 1993 by Section 1015 of the Intermodal Surface Transportation Efficiency Act of 1991. This apportionment is effective October 1, 1992. This Notice amends Notice 4510.287 dated October 5, 1992.

  2. BACKGROUND. An issue was raised concerning the allocations used in calculating the apportionment of Apportionment Adjustment funds. The funds made available in accordance with Section 1006(h) of the Intermodal Surface Transportation Efficiency Act of 1991 (PL 102-240) were included in the prior year allocations provided to the States. Upon further careful review it has been determined that these funds should not be included in the allocations to any individual State, but must be considered in the total net allocations provided to all States.

  3. ACTION. Division Administrators should assure that copies of this Notice are furnished to State highway agencies.

FISCA YEAR ENDING SEPTEMBER 30, 1993

The Secretary of the Treasury of the United States and the State Highway Departments:

Pursuant to section 9503 of the Internal Revenue Code of 1986, title 23, United States Code, entitled "Highways", Intermodal Surface Transportation Efficiency Act of 1991, and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator, section 1.48 of title 49, Code of Federal Regulations, I hereby certify --

First, that the Secretary of the Treasury has made the estimates required by section 9503(d) of the Internal Revenue Code of 1986 and, based on such estimates, I have determined that $685,713,901 can be apportioned for the fiscal year ending September 30, 1993, for apportionment adjustments, which is the amount needed to carry out section 1015 of the Intermodal Surface Transportation Efficiency Act of 1991 for that fiscal year and which is authorized to be appropriated in section 1015(e) of the Intermodal Surface Transportation Efficiency Act of 1991.

Second, that I have determined that the funds made available by section 1006(h) of the Intermodal Surface Transportation Efficiency Act of 1991 for National Defense Highways located outside the United States shall not be considered an allocation to any State; however, they shall be considered in the total allocated to all States.

Third, that I have computed the apportionment for apportionment adjustments among the eligible States in the manner provided by law in accord with section 1013(a), (b), and (c) of the Intermodal Surface Transportation Efficiency Act of 1991.

Fourth, that one-half of the amounts apportioned herein are subject to the provisions of section 133(d)(1), (2), and (3) of title 23, United States Code, concerning the allocation of apportioned Surface Transportation Program Funds.

Fifth, that the sums which are apportioned and made available to the eligible States, effective immediately, are as follows:
