FISCAL (FY) 1998 MINIMUM ALLOCATION FUNDS

  1. PURPOSE. To provide the States with advance notice and the certificate of apportionment of Minimum Allocation funds authorized by the Surface Transportation Extension Act of 1997 (STEA). THE APPORTIONMENT IS EFFECTIVE JANUARY 26, 1998.

  2. BACKGROUND. Section 2(d) of STEA authorizes $15,460,000 to be allocated to the States based on each State's proportional share of the FY 1997 apportionment under section 157 of title 23, United States Code. The amounts apportioned for FY 1998 are shown on the attached table.

  3. AVAILABILITY

    1. Pursuant to the provisions of section 2(f) of the STEA, these funds are available for obligation as if they had been apportioned under chapter 1 of title 23, United States Code.

    2. The funds are exempt from the State-by-State limitation on Federal-aid highway program obligations.

    3. The funds are subject to section 2(e)(3) of the STEA which provides that a State shall not obligate any funds for any Federal-aid highway program after May 1, 1998, until enactment of a multi year law reauthorizing the Federal-aid highway program.

    4. Appropriation codes to be used when obligating these funds will be provided by memorandum to regional and divisional offices.

  4. ACTION. Division Administrators should ensure that copies of this Notice are furnished to State Departments of Transportation.

MADE AVAILABLE FROM THE HIGHWAY TRUST FUND TO CARRY OUT
SECTION 157 OF TITLE 23, UNITED STATES CODE
PURSUANT TO THE SURFACE TRANSPORTATION EXTENSION ACT OF 1997

The Secretary of the Treasury of the United States and the State Highway Departments:

Pursuant to section 9503 of the Internal Revenue Code of 1986, the Intermodal Surface Transportation Efficiency Act of 1991, title 23, United States Code, and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator in section 1.48, title 49, Code of Federal Regulations, I certify--

First, that the Secretary of the Treasury has made the estimate required by section 9503(d) of the Internal Revenue Code of 1986 and based on that estimate, I have determined that the amount which can be apportioned from the Highway Trust Fund to carry out section 1003(e) of Pub. L. No. 102-240, the Intermodal Surface Transportation Efficiency Act of 1991, as amended by section 2(d) of the Surface Transportation Extension Act of 1997 (STEA) for projects eligible under 23 U.S.C. § 157, is $15,460,000 which is 100 per centum of the amount authorized to be made available from the Highway Trust Fund pursuant to section 1003(e) of the Intermodal Surface Transportation Efficiency Act of 1991, as amended.

Second, that pursuant to section 2(f)of the STEA, these funds are available for obligation as if they had been apportioned under chapter 1 of title 23, United States Code. Third, the amounts allocated to each State under this authorization is determined in accordance with section 1003(e)(2) of Pub. L. No. 102-240, as amended by section 2(d) of the STEA.

Fourth, the amounts allocated are subject to obligation controls contained in section 2(e)(3) of the STEA which provides that a State shall not obligate any funds for any Federal-aid highway program after May 1, 1998 (except for reobligations of previously obligated funds) until enactment of a multi year law reauthorizing the Federal-aid highway program.

Fifth, that, I have computed the allocation among the several States, the Commonwealth of Puerto Rico and the District of Columbia of the amounts authorized to be made available from the Highway Trust Fund pursuant to 1003(e)(2) of Pub. L. No. 102- 240, as amended, in the manner provided by law.

Sixth, the sums which are hereby allocated to each State, the District of Columbia, and the Commonwealth of Puerto Rico, effective immediately, are respectively as follows:
