  1. What is the purpose of this Notice? This Notice is to notify the States, pursuant to the provisions of 23 U.S.C. 104(e), of the status of anticipated apportionments under 23 U.S.C. 104, effective October 1, 2003. Under the provisions of 23 U.S.C. 104(e), each State must be advised of the amounts that will be apportioned each year no later than 90 days before the beginning of the fiscal year.

  2. What is the status of the Advance Notification of apportionments? The advance notification of the anticipated apportionment of Federal-aid highway funds cannot be provided at this time pending action by the Congress to reauthorize the program beyond fiscal year 2003.

  3. What action is required? Division Administrators should ensure that this Notice is provided to State departments of transportation.
