  1. What is the purpose of this Notice? This Notice is to advise of the redistribution of FY 2007 obligation authority to the States pursuant to Section 1102(d) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), Public Law Number (Pub. L. No.) 109-59 and Section 21011 of the Revised Continuing Appropriations Resolution, 2007, Pub. L. No. 110-5.

  2. How much obligation authority is available for redistribution? A total of $1.2 billion of obligation authority is available for redistribution for FY 2007.

  3. How much obligation authority was requested? The States requested a total of $9.2 billion in additional obligation authority for FY 2007.

  4. How is the returned obligation authority redistributed? The amounts are to be redistributed in accordance with the requirements of Section 1102(d) of the SAFETEA-LU, so that priority will be given to those States having large un-obligated balances of funds apportioned under Section 104 and 144 of Title 23, United States Code. The attached table shows the redistribution of unused obligation authority to the States.

  5. What action is required? Division Administrators should ensure that that this additional obligation authority is obligated no later than September 26, 2007.
