FHWA DELEGATIONS AND ORGANIZATION MANUAL - CHANGE

  1. PURPOSE. To issue revised pages to the FHWA Delegations and Organization Manual.

  2. EXPLANATION OF CHANGES. Part I (Delegations of Authority), Chapter 5 (Federal-aid), Section 3 (Engineering and Operations) is amended as follows:

    1. Paragraph 54 currently pertains solely to certification acceptance. The scope of the paragraph is expanded to cover additional certifications in Title 23 of the U.S. Code and Titles 23 and 49 of the Code of Federal Regulations, as well as actions resulting from noncompliance with requirements related to the certifications. This change implements a recommendation included in the Headquarters Streamlining Implementation Plan that approval authority for Title 23 certifications be decentralized to the field. Only the authority pertaining to certification of highway planning and research funds (23 U.S.C. 307(c)(2)) and the authority to withhold Federal-aid apportionments due to noncompliance with requirements related to the certifications is retained in Headquarters.

    2. Paragraph 56, pertaining to the national maximum speed limit, is cancelled and reserved due to repeal of the speed limit program by Section 205(d) of the National Highway System Designation Act of 1995.
