1. What is the purpose of this change? This is an administrative change, issuing revised chapters to this Manual. This Order incorporates organizational changes that the Secretary or Administrator previously approved in the FHWA Section of the DOT Organization Manual, memorandums, etc.

2. Which parts of FHWA Order M 1100.1A are being updated? This update replaces the Introduction and all of Part II (Organization and Functions), except for Chapter 1 (General). Regarding Part II, former chapters 2 through 10 are replaced with the new Chapters 2 through 16. Part II is also updated to include a revised and consolidated Table of Contents, organization charts, and maps reflecting the field offices. Also, this Order and the revised chapters are rewritten in a question and answer format following the plain language guidelines in the FHWA Directives Management Program Handbook (FHWA Order H 1321.1B).

3. What organizational changes have occurred and/or are included in this Order? The following organizational changes have occurred and are reflected in the revised chapters, unless otherwise indicated.
   1. The field restructuring resulted in the establishment of four resource centers and the abolishment of the former nine regions and regional offices. (DOT 1100.63A, Change 2, signed by the Secretary on October 16, 1998)

   2. The Washington Headquarters restructuring resulted in the establishment of a matrix organization consisting of five CBUs (Planning and Environment; Infrastructure; Operations; Federal Lands Highway; and the former Motor Carrier and Highway Safety CBU) and eight cross-cutting SBUs (Policy; Chief Counsel; Public Affairs; Civil Rights; Corporate Management; Research, Development, and Technology; Professional Development; and Administration). The CBUs and SBUs replaced the former Staff Offices and Associate Administrator organizational elements. (DOT 1100.63B, signed by the Secretary on February 2, 1999)

   3. Formal substructures were established for the Chief Counsel and Administration SBUs, and for the former Motor Carrier and Highway Safety CBU. (Memorandum signed by the Administrator on May 21, 1999)

   4. The Administration SBU's Office of Information and Management Services was streamlined by abolishing the Publishing and Visual Communications Division and merging the former organizational element into the Management Services Division effective November 1, 1999. Therefore, the former Publishing and Visual Communications Division is not referenced in Chapter 15 (Administration Service Business Unit). (FHWA Order M 1100.1A change order, signed by the Administrator on October 25, 1999)

   5. A Safety CBU was established and the Motor Carrier and Highway Safety CBU was formally abolished. Associated references to the former Motor Carrier and Highway Safety CBU were deleted from the DOT Organization Manual. (DOT 1100.63B, Change 1, signed by the Secretary on February 22, 2000)

      Note: The FY 2000 Department of Transportation and Related Agencies Appropriations Act, signed by the President on October 9, 1999, contained language prohibiting the use of the funds appropriated or limited in the Act to carry out the functions and operations of the "Office of Motor Carriers" within the FHWA. This effectively resulted in the transfer of motor carrier functions and operations out of the FHWA. By action of the Secretary, motor carrier functions and operations were transferred out of the FHWA effective October 9, 1999. Also, the Office of Highway Safety Infrastructure and a few other elements in the former Motor Carrier and Highway Safety CBU, which had been transferred to the Infrastructure CBU on an interim basis, moved to the Safety CBU. This effectively abolished the Office of Highway Safety Infrastructure, therefore, Part II changes to this Manual do not include references to this former office.

   6. The Chief Counsel SBU reorganized.
      (1) Change 2 to DOT 1100.63B, signed by the Administrator on June 5, 2000, revised mission and functions statements to:

      (a) reflect in additional statements that legal advice and services are provided to FMCSA through a Memorandum of Understanding; and

      (b) reflect that the SBU provides legal advice on the North American Free Trade Agreement (NAFTA) and border crossing activities, including freight movements and international agreements. Primary responsibility for the implementation of NAFTA transferred to the immediate office of the Chief Counsel; however, the Motor Carrier and Highway Safety Law Division continues to also provide legal advice in this area.

      (2) Change 17 to FHWA Order M 1100.1A, signed by the Administrator on June 5, 2000, revised mission and functions statements to reflect the changes in paragraph 3f(1) above and to:

      (a) establish the Administrative and Technology Law Division; and

      (b) reassign various functions that were previously performed by the Program Legal Services Division and the Legislation and Regulations Division to the Administrative and Technology Law Division.

   7. Resource Center Directors were retitled as Directors of Field Services (East, South, Midwest, or West), and Operations Managers were retitled as Resource Center Managers, per a memorandum signed by the Executive Director on June 23, 2000. In addition, changes were made regarding their roles and responsibilities.
