Note: The FY 2000 Department of Transportation and Related Agencies Appropriations Act, signed by the President on October 9, 1999, contained language prohibiting the use of the funds appropriated or limited in the Act to carry out the functions and operations of the "Office of Motor Carriers" within the FHWA. This effectively resulted in the transfer of motor carrier functions and operations out of the FHWA. By action of the Secretary, motor carrier functions and operations were transferred out of the FHWA effective October 9, 1999. Also, the Office of Highway Safety Infrastructure and a few other elements in the former Motor Carrier and Highway Safety CBU, which had been transferred to the Infrastructure CBU on an interim basis, moved to the Safety CBU. This effectively abolished the Office of Highway Safety Infrastructure, therefore, Part II changes to this Manual do not include references to this former office.
(a) reflect in additional statements that legal advice and services are provided to FMCSA through a Memorandum of Understanding; and
(b) reflect that the SBU provides legal advice on the North American Free Trade Agreement (NAFTA) and border crossing activities, including freight movements and international agreements. Primary responsibility for the implementation of NAFTA transferred to the immediate office of the Chief Counsel; however, the Motor Carrier and Highway Safety Law Division continues to also provide legal advice in this area.
(2) Change 17 to FHWA Order M 1100.1A, signed by the Administrator on June 5, 2000, revised mission and functions statements to reflect the changes in paragraph 3f(1) above and to:
(a) establish the Administrative and Technology Law Division; and
(b) reassign various functions that were previously performed by the Program Legal Services Division and the Legislation and Regulations Division to the Administrative and Technology Law Division.
