Decision Flowchart of Wild & Scenic River's Act

  1. Is the project federally funded or assisted?
    1. If yes, go to #2.
    2. If no, go to #14.

  2. Is the project a "water resources project"?
    1. If yes, go to #3.
    2. If no, go to #14.

  3. Determine river status and project location.
    1. Effect on listed river, go to #4.
    2. No effect on listed river, go to #14.

  4. Determine affected river
    1. On the NRI, go to #5.
    2. Within a designated WSR corridor, go to #9.
    3. Within a congressionally authorized WSR study list corridor, go to #9.
    4. Outside a designated WSR corridor, go to #10.
    5. Outside a congressionally authorized WSR study list corridor, go to #11.

  5. Could project affect an NRI river?
    1. If yes, go to #6.
    2. If no, go to #14.

  6. Could project have an adverse effect?
    1. If yes, go to #7.
    2. If no, go to #14.

  7. Could project foreclose options to classify any portion as a WSR?
    1. If yes, go to #8.
    2. If no, go to #14.

  8. Incorporate avoidance/mitigation measures to maximum extent. Go to #14.

  9. Section 7 evaluation under "direct and adverse" standard. Go to #12.

  10. Section 7 evaluation under "invade the area or unreasonably diminish" standard. Go to #12.

  11. Section 7 evaluation under "invade the area or diminish" standard. Go to #12.

  12. Objection?
    1. If yes, go to #13.
    2. If no, go to #14.

  13. Revise plans?
    1. If yes, go to #12.
    2. If no, go to #15.

  14. Compliance satisfied.

  15. Project cannot be accomplished.
