OBJECTIVES OF THE PROGRAM
The Eisenhower Legal Intern Fellowship is sponsored by the Office of the Chief Counsel, Federal Highway Administration (FHWA). Recipients of the Eisenhower Legal Intern Fellowship will receive challenging assignments on an array of legal issues that will provide the candidate with an understanding of the relationship between Federal, State, and local governments, FHWA and other Federal agencies.
Working under the direction of a FHWA Assistant Chief Counsel, Team Leader, or Senior Attorney, assignments may include work on matters such as: environmental policy and legal challenges; development of critical highway and construction policies; development of legislative proposals and federal regulations; support of the DOT Intelligent Transportation System; internal agency issues such as personnel matters, FOIA requests, and ethics matters; and FHWA program area issues relating civil rights, the distribution and reimbursements of Federal-aid highway funds, torts, litigation, contract, and contract matters.
BACKGROUND OF DDETFP
The objective of the Eisenhower Transportation Fellowship Program is to attract qualified students to the field of transportation education and research and advance transportation workforce development. The Program is intended to help expand the scope of knowledge of the entire transportation community in the United States and encompasses all modes of transportation.
ELIGIBILITY REQUIREMENTS
Eisenhower Legal Intern Fellowship applicants must be enrolled in an American Bar Association (ABA) accredited U.S. institution of higher education, must be pursuing a law degree in a full-time program, must be a second or third year student and should be planning to enter the transportation profession after completing their higher level education.
The Eisenhower Legal Intern Fellowship is intended for:
Students who are in their second year toward a J.D., degree, and will complete their second year before being awarded a fellowship;
Students who are in their third year toward a J.D. degree; and
Students who have completed their J.D. degree and are enrolled in an ABA accredited program leading to a LL.M., J.S.D. or equivalent degree.
RESEARCH PROJECT
The Eisenhower Legal Intern Fellowship recipients will conduct research (full-time) at one of the FHWA Office of Chief Counsel locations in Washington, DC; Atlanta, GA; Baltimore, MD; Olympia Fields, IL; Denver, CO; San Francisco, CA; Vancouver, WA; and Reston, VA. Each intern must have a faculty advisor assigned to provide academic supervision. Interns may receive academic credit from their university to be determined by their faculty advisor. The faculty advisor will determine the amount of academic credit.
Eisenhower Legal Intern Fellowship recipients are required to attend the Transportation Research Board (TRB) Annual Meeting held each January in Washington, D.C. and prepare a presentation on their project.
CRITERIA FOR EVALUATION
The Eisenhower Legal Intern Fellowship will be awarded on the basis of merit. Evidence of merit will include:
Match of the applicant’s qualifications to accomplish the objectives of the Legal Intern Fellowship;
Recommendation letters regarding the applicant’s qualifications;
Academic records, including class standing, GPA and transcripts; and
Transportation work experience, if any, including employer’s endorsement.
SELECTION
The Eisenhower Legal Intern Fellowship Review Panel will evaluate the applicants. This panel will be comprised of transportation professionals and will be convened in Washington, D.C.
The recommendations for selection will be ranked in merit order and furnished to the Program Manager, Universities and Grants Programs (U&GP). The Chief Counsel in consultation with the Program Manager, will make final selections.
TENURE
The tenure for an Eisenhower Legal Intern Fellowship recipient is four to twelve months.
STIPEND, TUITION AND TAXES
Fellowship recipients should be advised that the stipend portion of the fellowship is subject to taxation in accordance with the Internal Revenue Service (IRS) regulations (Publication 520, revised June 2002).
The stipend for the Eisenhower Legal Intern Fellowships is as follows:

J.D. $1,700/mo.
LL.M. $2,000/mo.
Tuition and fees that relate to the academic credits for the approved research project will be paid in full. There is a $10,000 tuition cap for the Masters (J.D.) and Doctoral level (LL.M.). Eisenhower Legal Intern Fellowship recipients will be paid a travel allowance for a reasonable cost of travel to and from the FHWA location where they will work. Faculty advisors will be funded for one site review on projects that last over six months. Faculty advisors will be allowed two site reviews for projects over nine months. Faculty advisors will be allowed travel and per diem for each visit to the DOT facility to perform a site review with their student.
Restrictions on the use of fellowship funds are as follows:
No dependency allowances;
No reimbursement of university administrative/ indirect costs;,
Legal intern recipients are eligible for funding only during those months in which they are conducting (full-time) research at a DOT facility or another approved facility;
Grants for stipend, tuition and other costs will be executed between the DOT operating administration and the university on behalf of the student by the Director, Universities & Grants Programs;
The recipient’s university has the responsibility of administering the funds and for making periodic payments to the recipient; and
Unused funds must be returned to the Federal Highway Administration/National Highway Institute (FHWA/NHI) within 30 days of the termination of the fellowship.
CONDITIONS OF ACCEPTANCE
A major change in the research topic or an extension in time to complete the research must be approved by the Chief Counsel, who will consult with the Program Manager, Universities & Grants Programs. Eisenhower Legal Intern Fellowship recipients must conduct original research and prepare a paper or report suitable for publication on the topic for which they are selected. Recipients must make the results of their research available to the U.S. Department of Transportation (DOT) and the Department will retain an unlimited royalty-free privilege to use the results of the research.
Recipients are responsible for finding their own housing accommodations when they arrive at the DOT facility. Some of the DOT facilities may require use of an automobile for commuting purposes.
SCHEDULE
Applications for Eisenhower Legal Intern Fellowship will be accepted until filled. Send the application to the address in the section on "How to Apply".
Potential recipients under the Eisenhower Legal Intern Fellowship will be contacted in writing to determine acceptance of the award. Once the award has been made, recipients may begin conducting research at a DOT facility at anytime during the academic year. Each fellowship will be awarded to the university on behalf of the recipient approximately thirty days prior to the start date

Applicants for the Eisenhower Legal Intern Fellowship must submit their applications through their Faculty Advisors and be nominated for fellowship awards by their respective universities. General Instructions: Please read the Eisenhower Legal Intern Fellowship Announcement and these instructions before preparing the application materials. Applicants must submit one original (with signatures) and three copies of all materials. All materials must be typed.
Applicants should request that an official transcript be sent to the above address; however a copy may be accepted pending receipt of the official transcript.
Complete Application: A completed application must be typed and will consist of:
Eisenhower Legal Intern Fellowship Application (Parts 1-3);
Academic records, including certified transcripts, class standing and GPA;
Three recommendations and/or employer's endorsement letters; and
Resume / CV.
It is permissible to use copies of the application.
Application - Part 1: All requested information must be provided unless labeled “optional”. If an item is not available, state “N.A.”. The application must be signed and dated in blue or black ink.
Application - Part 2: List only those universities where a degree was obtained. Provide a history of employment. Each applicant must have at least three recommendation and/or endorsement letters. The letters must be received at the address under “How to Apply”. If you are currently employed in a transportation or legal function, it is imperative that your employer submits an endorsement letter. The recommendation and endorsement letters should contain the length and nature of the person’s relationship with the applicant and comments on the nominee’s overall ability, suitability for graduate school and potential for major contributions in one or more areas of transportation.
Application - Part 3: Provide a brief statement explaining your interest in one of the following legal areas: environmental policy and legal challenges; development of critical highway and construction policies; development of legislative proposals and federal regulations; support of the DOT Intelligent Transportation System; internal agency issues such as personnel matters, FOIA requests, and ethics matters; and FHWA program area issues relating to civil rights, the distribution and reimbursements of Federal-aid highway funds, torts, litigation, contract, and contract matters
Mailing the Application: When possible, applicants are urged to submit an application and supporting documents in the same envelope. Universities are permitted to send transcripts directly to the address shown in the “How to Apply” section.
RETURN OF MATERIALS: Neither the application, or the materials submitted in support of the application will be returned to an applicant.
