Preparing the Compliance
  Review Report


Once the review is completed with the state, it is time to develop a final compliance review report. The final report should present the findings from the proof of payment compliance review. It should also include state responses to the questions posed in the HVUT compliance review questionnaire.

In the final report, you should detail any findings that occurred during the review, as well as recommendations for improvement within the state. The final report should conclude with a determination of compliance or non-compliance. A finding of non-compliance needs to be accompanied with a detailed discussion of problems that need to be addressed by the state.

A best practice HVUT compliance review report could have an outline as follows:

The reviewer should provide a copy of the draft report to the state and invite comments. Offer a follow-up meeting with state personnel to discuss findings and recommendations, as well as to address any questions or concerns they have with the compliance review process. Once you have addressed the state's concerns, review the draft final report with relevant FHWA division and HQ staff, discuss the results, incorporate any additional information or changes into the report. Then file the report.

Note: Remember that the state may not agree with all of your findings. After all, this is a compliance review and if the state has been lax in enforcing the HVUT requirement, that finding, while accurate, may not be well received by your state partners. Thus, in some cases, you may need to note the dissenting opinion of the state while holding to your preliminary finding. To the extent the state is able to present evidence to support their arguments, this information should be taken into account when preparing your findings.
