Questions and Answers Regarding Section 113(a) of the SAFETEA-LU Technical Corrections Act of 2008 (Public Law 110-244)

Question (Q1): Does Section 113(a) of the SAFETEA-LU Technical Corrections Act of 2008 (Public Law 110-244) allow for the funding of these minor collectors to be retroactive over the entire period of SAFETEA-LU.

Answer (A1): While technically not retroactive, the special rule may be applied to any remaining L250 Program Code funds still available from these prior fiscal years. The Division should verify the availability of the funds, including the 15% limit, for the fiscal year.
