FHWA Washington Division > Environment > Cultural Resources - Historic and Archaeological Sites
"Cultural Resources" in this context means historic properties, archaeological sites, and "Traditional Cultural Properties" that have importance to a group of people. The regulations give extra protection to those properties that are on or eligilble for listing on the National Register of Historic Places.
The two primary laws relating to transportation impacts on Cultural Resources are Section 106 of the National Historic Preservation Act and Section 4(f) of the 1966 Highway Act.

The FHWA Washington Division has entered into a statewide Section 106 Programmatic Agreement with the Washington State DOT and the Washington Office of Archaeology and Historic Preservation. This agreement provides for exemption of some projects which are unlikely to impact cultural resources from the requirements of Section 106.

The FHWA Washington Division and the Washington State DOT are negotiating Programmatic Agreements with each Native American Tribe with lands or interest in the state of Washington. Our goal is to execute an agreement with each tribe. We currently have one completed agreement. Others are currently in development and will be posted here when they are complete.
