Section 1214(e) of the Transportation Equity Act for the 21st Century (TEA-21) provides for reconstruction of a highway or portion of a highway located outside of the United States, after consultation with the Secretary of Defense indicates that the highway is important to the national defense. The Department of Defense indicated in their July 14, 1992, letter, that the Alaska Highway and the Haines Road were strategically significant and important for the national defense.

In accordance with Section 1214(e), $18,800,000 is available each of fiscal years 1998 through 2002 for the above reconstruction project from amounts to be apportioned under 23 U.S.C. 104(b)(4), Interstate Maintenance. In applying the provisions of Section 1102(f) of TEA-21 concerning the redistribution of certain allocated funds, only $16,920,000 will be made available in FY 1998. The remaining $1,880,000 will not be available, but instead is distributed to the States in accordance with Section 1102(f).

We are allocating $16,920,000 of appropriation code QK1 funds to Alaska and providing an equal amount of obligation authority. The Federal share for these funds is 100 percent, and the funds are available until expended.

These funds are available for projects to reconstruct the Alaska Highway in Canada from the Alaska border south to Haines Junction, and the Haines Road from the Alaska Highway at Haines Junction to the Alaska border near Haines. These are the sections of highway covered by the SHAKWAK agreement.
