Dear Ms. Martinez:
The Federal Highway Administration (FHWA) received your request for an exception to the Federal regulatory requirement to charge fair market value for the use of the right-of-way for non-highway purposes at the Park and Ride Lot located at 10 Miry Brook Road in Danbury, Connecticut.
The FHWA reviewed the information provided and is approving this request in accordance with 23 CFR 710.403. The FHWA determined the establishment and operation of a COVID-19 testing and vaccination site (along with related activities and temporary storage of trailers and necessary equipment) that is offered free of charge to the public is in the overall public interest based on a social benefit in response to the COVID-19 pandemic.
The Connecticut Department of Transportation is responsible for: ensuring this non-highway use will not impair the Park and Ride Lot nor interfere with the free and safe flow of traffic; ensuring that any biohazardous materials will be properly disposed; and adhering to the terms set forth in the license agreement.
