Section 1201 Maintenance of Effort

Title XII of the Recovery Act includes a provision in section 1201 that requires the Governor of a State to certify to the Secretary of Transportation that the State will maintain its effort with regard to State funding for the types of projects funded by the appropriation. This is a Department-wide provision. Guidance issued by the Office of the Secretary is available at http://www.dot.gov/recovery/guidance.

FHWA has issued additional section 1201 guidance in response to questions about implementing section 1201 in the context of the Highway Infrastructure Investment appropriation.
