FEDERAL-AID POLICY GUIDE - CHANGE

  1. PURPOSE. To transmit new pages to the Federal-Aid Policy Guide (FAPG).

  2. BACKGROUND. One of the primary objectives of the establishment of the FAPG was to identify and validate Federal-aid policies and procedures issued in nondirective format (e.g., memorandums) and incorporate these materials into the directives system. As part of this "FAPG Phase II" project, the Washington Headquarters program offices have delineated the still valid provisions contained in memorandums pre-dating the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) and submitted them to the Office of Management Systems. This is the first in a series of changes to issue the retained material in FAPG format and cancel the respective memorandums. The last transmittal in this series will also cancel all pre-ISTEA memorandums not incorporated into the FAPG.

  3. COMMENTS

    1. Current non-regulatory guidance material, which was previously issued in non-directive format, is being incorporated into the FAPG as follows:

        (1) NS 23 CFR 140I is established to incorporate the provisions of the following memorandums:

          (a) Railroad Equipment Rates dated July 18, 1990, signed by the Director, Office of Engineering;

          (b) Equipment Rental Rates dated November 7, 1988, signed by the Chief, Construction and Maintenance Division, Office of Highway Operations;

          (c) Equipment Rental Rates dated December 23,1986, signed by the Director, Office of Highway Operations;

          (d) Materials Certifications dated October 18, 1985, signed by the Chief, Construction and Maintenance Division, Office of HighwayOperations;

        (2) NS 23 CFR 645A is established to incorporate the provisions of the following issuances;

          (a) Memorandums:

            1 Use of Fixed Amount Payments to Railroads or Utilities dated April 14, 1989, signed by the Director, Office of Engineering;

            2 New Utility Relocation, Adjustment and Reimbursement Regulation dated April 9, 1986, signed by the Chief, Federal-Aid Division;

            3 Federal-Aid Reimbursement Policy -Utility Relocation Projects dated February 26, 1988, signed by the Chief, Federal-Aid and Design Division;

            4 Utility Relocations Under Section 405 of the STURAA of 1987 dated September 3, 1987, signed by the Associate Administrator of Engineering and Program Development;

            5 Utility and Railwork - Wage Rate and EEO Requirements dated May 15, 1985, signed by the Acting Chief Counsel;

            6 Utility and Railroad Wage Rate and EEO Requirements dated May 23, 1985, signed by the Director, Office of Engineering;

            7 Utility and Railroad Work - Contract Requirements dated September 12, 1985, signed by the Associate Administrator for Engineering and Operations;

            8 Loss of Revenue dated December 6, 1971, signed by the Chief, Federal-Aid Division;

            9 Relocation of Utilities - Effect of New Tax Law dated January 20, 1988, signed by the Deputy Federal Highway Administrator; and

            10 Federal-Aid Reimbursement to Adjust Utilities Improperly Installed on Highway Right-of-Way dated December 20,1984, signed by the Director, Office of Engineering.

          (b) Federal Register Notice, Utility Relocations, Adjustments, and Reimbursement; Acquisition of Replacement Right-of-Way dated February 6, 1991, signed by the Federal Highway Administrator.

          (c) A Notice of Proposed Rulemaking, Utility Relocations, Adjustments, and Reimbursement dated November 20, 1980, signed by the Federal Highway Administrator.

        (3) NS 23 CFR 646B is revised to incorporate the provisions of the following memorandums:

          (a) Use of Fixed Amount Payments to Railroads or Utilities dated April 14, 1989, signed by the Director, Office of Engineering.

          (b) Utility and Railroad - Wage Rate and EEO Requirements dated May 15, 1985, signed by the Acting Chief Counsel;

          (c) Utility and Railroad Work - Wage Rate and EEO Requirements dated May 23, 1985, signed by the Director, Office of Engineering;

          (d) Utility and Railroad Work - Contract Requirements dated September 12, 1985, signed by the Associate Administrator for Engineering and Operations;

          (e) Appropriation Codes for Section 203 Projects dated May 8, 1986, signed by the Associate Administrator for Safety and Operations;

          (f) Installation of Warning Devices at Grade Crossings dated September 3, 1976, signed by the Director, Office of Engineering;

          (g) Rail-Highway Crossing Program Federal Share Payable dated March 20, 1979, signed by the Associate Administrator for Safety; and

          (h) Use of HBRRP Funding for Highway Bridges not Presently Owned and Maintained by a Public Authority dated August 21, 1984, signed by the Associate Administrator for Engineering and Operations.

    2. The non-directive issuances listed in paragraph 3a are canceled.

  4. REGULATORY MATERIAL. The pages contained in this change contain no regulatory material.

  5. ACTION. Each recipient office is responsible for filing the attached FAPG pages into the binders provided.
