REAPPORTIONMENT OF THE PRIMARY MINIMUM
PORTION OF CONSOLIDATED PRIMARY FUNDS
AND MINIMUM ALLOCATION FUNDS SEQUESTERED

  1. PURPOSE. To transmit a certificate of apportionment for Fiscal Year (FY) 1990 Primary Minimum Portion of Consolidated Primary an 85 percent Minimum Allocation Funds.

  2. BACKGROUND. Pursuant to the Omnibus Reconciliation Act of 1989 and the Balanced Budget and Emergency Deficit Control Act of 1985, FHWA Notice N 4510.248 dated January 11, 1990, was issued. This action resulted in $184,314,270 in apportionments being canceled. These amounts were permanently canceled, except that amount authorized for the Federal-aid Primary System under Section 108(d) of the Surface Transportation Assistance Act of 1982 and for the Minimum Allocation Funds under Section 157(e) of Title 23 U.S.C.

  3. AVAILABILITY. The Consolidated Primary Funds and the Minimum Allocation Funds, resulting from this Notice, are subject to lapse on September 30, 1993, if they have not been obligated for projects. These funds will be made available under appropriation code 010 for Consolidated Primary and appropriation code 160 for Minimum Allocation.

  4. OBLIGATION AUTHORITY. Attachment 2 provides obligation authority for the funds being made available for Consolidated Primary.

  5. ACTION. Division Administrators should assure that copies of this Notice are furnished to each State Highway Agency.

The Secretary of the Treasury of the United States, the State Highway Departments, the Governor of the Virgin Islands, the Governor of American Samoa, the Governor of Guam, and the Governor of the Commonwealth of the Northern Mariana Islands:

Pursuant to section 9503 of the Internal Revenue Code of 1986, the Surface Transportation Assistance Act of 1982, the Surface Transportation and Uniform Relocation Assistance Act of 1987, the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, the Omnibus Budget Reconciliation Act of 1989, Title 23, U.S.C., entitled, "Highways" and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator, 49 CFR 1.48, I hereby certify--

First, that pursuant to an apportionment certificate attached to FHWA Notice N 4510.248 dated January 11, 1990, $184,314,270 in apportionments were canceled pursuant to the Omnibus Reconciliation Act of 1989 and the Balanced Budget and Emergency Deficit Control Act of 1985.

Second, that pursuant to the Balanced Budget and Emergency Deficit Control Act of 1985 said $184,314,270 in apportionments were permanently canceled with the exception of apportionments included therein which were authorized tobe appropriated for the FHWA NOTICE N 4510.261 consolidated Federal-Aid Primary System under section 108(d) of the Surface Transportation Assistance Act of 1982 and for the Minimum Allocation under section 157(e) of Title 23, United States Code.

Third, that said apportionments that were not permanently canceled are restored and apportioned as follows:
