NOTICE

ADVANCE NOTIFICATION PURSUANT TO
23 U.S.C. 104(e)

June 25, 1991

  1. PURPOSE. To notify the States, pursuant to provisions of 23 U.S.C. 104(e), of the status of anticipated apportionments under 23 U.S.C. 104 effective October 1, 1991.

  2. REQUIREMENT. Under the provisions of 23 U.S.C. 104(e), each State must be advised of the amount that will be apportioned each year under 23 U.S.C. 104 no later than 90 days before the beginning of the fiscal year.

  3. STATUS

    1. Advance notification of the anticipated apportionment of Interstate Construction funds authorized for FY 1993 to be apportioned on October 1, 1991, cannot be provided at this time since the Congress has not yet approved factors required to compute the apportionment.

    2. Advance notification of the anticipated apportionment of non-Interstate funds cannot be provided at this time since FHWA does not have authorizations beyond FY 1992 for the Interstate 4R program or beyond FY 1991 for the Consolidated Primary, Rural Secondary, or Urban System programs.

  4. ACTION. Division Administrators should assure that copies of Notice are furnished to State highway agencies.
