Apportionment of the Fiscal Year (FY) 1992 Interstate Substitute Highway Funds

  1. PURPOSE. To transmit the certificate of apportionment for Interstate substitute highway funds authorized for FY 1992 pursuant to the Intermodal Surface Transportation Efficiency Act of 1991. The apportionment is effective December 18, 1991.

  2. AVAILABILITY
    1. The Interstate substitute highway funds resulting from this apportionment are available for obligation until September 30, 1993. Amounts not obligated by the State on or before September 30, 1993, (other than an amount which, by itself, is insufficient to pay the Federal share of the cost of a substitute project which has been submitted by the State to the Secretary for approval) will be withdrawn and will be reapportioned.

    2. The funds resulting from this apportionment are available for obligation on December 18, 1991, and will be subject to obligation control procedures in force at the time of obligation.

    3. The participating rate for these funds is 85 percent.

    4. The appropriation code is 177.


  3. ACTION. Division Administrators should ensure that copies of this Notice are furnished to State highway agencies.

CERTIFICATE OF APPORTIONMENT FROM
THE SUM OF $240,000,000 MADE AVAILABLE
FOR SUBSTITUTE PROJECTS
FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1992

To--

The Secretary of the Treasury of the United States and the State Highway Departments:

Pursuant to section 9503 of the Internal Revenue Code of 1986, title 23, United States Code, entitled "Highways", the Intermodal Surface transportation Efficiency Act of 1991, and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator, section 1.48 of title 49, Code of Federal Regulations, I certify--

First, that the Secretary of the Treasury has made the estimate required by section 9503(e) of the internal Revenue Code of 1986, and based on such estimate, I have determined that $240,000,000 is available for substitute projects for the fiscal year ending September 30, 1992, which is 100 per centum of the amount made available for substitute projects for that fiscal year pursuant to section 103(e)(4)(G) of title 23, United States Code.

Second, that in compliance with section 104(a) of title 23, United States Code, I have estimated that it will be necessary for administering the provisions of title 23 and for highway research and studies, to deduct 2.75 per centum from the amounts made available for substitute projects for the fiscal year ending September 30, 1992, and I have deducted said 2.75 per centum from the sum of $240,000,000made available for the fiscal year ending September 30, 1992.

Third, that I have computed the apportionment among the eligible States of the remaining sums from the amounts made available for substitute projects for the fiscal year ending September 30, 1992, in the manner provided by law in accordance with section 103(e)(4)(H)(iii) of title 23, United States Code.

Fourth, that the sums which are hereby apportioned and made available to the eligible States, effective immediately, are as follows: [see table 1]
