APPORTIONMENT OF THE DONOR STATE BONUS FUNDS AUTHORIZED FOR FISCAL YEAR (FY) 1992

  1. PURPOSE. To transmit the certificate of apportionment for the donor state bonus funds authorized for FY 1992 by section 1013(c)(1)(A) of the Intermodal Surface Transportation Efficiency Act of 1991. The apportionment is effective December 18, 1991.

  2. APPORTIONMENT. The apportionment of these funds is based on (1) the apportionment of Minimum Allocation, Interstate Construction, Interstate Maintenance, Interstate Highway Substitute, National Highway System, Surface Transportation Program, and Bridge Program, funds apportioned effective December 18, 1991, and on (2) the allocations of FY 1991 Discretionary funds for Interstate Construction, Interstate 4R, Interstate Substitution and Bridge, and (3) the projected FY 1992 Highway Trust Fund receipts attributable to the States.

  3. AVAILABILITY
    1. The donor state bonus funds resulting from this apportionment are available until expended.

    2. The funds are available for obligation in the same manner and for the same purpose as if they were apportioned for the surface transportation program.

    3. Supplementary tables providing the appropriation codes and suballocation of these funds will issued in a separate notice.


  4. ACTION. Division Administrators should assure that copies of this Notice are furnished to State highway agencies.

$429,000,000 AUTHORIZED TO BE APPROPRIATED
FOR DONOR STATE BONUS AMOUNTS
FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1992

TO --

The Secretary of the Treasury of United States and the State Highway Departments:

Pursuant to title 23, United States Code, the Intermodal Surface Transportation Efficiency Act of 1991, section 9503 of the Internal Revenue Code of 1986, and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator, section 1.48 of title 49, Code of Federal Regulations, I certify --

First, that the Secretary of the Treasury has made the estimate required by section 9503(d) of the Internal Revenue Code of 1986 and base on that estimate I have determined that the amount which can be apportioned for donor state bonus amounts for the fiscal year ending September 30, 1992, is $429,000,000 which is 100 per centum of the amount authorized to be appropriated for that fiscal year by section 1013(c)(1)(A) of the Intermodal Surface Transportation Efficiency Act of 1991.

Second, that in compliance with section 104(a) of title 23, United States Code, I have estimated that it will be necessary for administering the provisions of title 23 and for highway research and studies, to deduct 2.75 per centum from the sum of $429,000,000 authorized to be appropriated for the fiscal year ending September 30, 1992, and I have deducted said 2.75 per centum.

Third, that after making said deduction, I have computed the apportionment among donor States of the remainder of the amount authorized to be appropriated for the fiscal year ending September 30, 1992, in the manner provided by section 1013(c)(2) (A) of the Intermodal Surface Transportation Efficiency Act of 1991.

Fourth, that one-half of the amounts apportioned herein are subject to the provision of section 133(d)(3) of title 23, United States Code, concerning the division of apportioned funds within a State.

Fifth, that after said deduction the sums which are hereby apportioned to donor States, effective immediately, are respectively as follows: [see table 1]
