APPORTIONMENT OF THE FISCAL YEAR (FY) 1999 RECREATIONAL TRAILS PROGRAM FUNDS

  1. PURPOSE. To transmit the certificate of apportionment of Recreational Trails funds authorized for FY 1999 by the Transportation Equity Act for the 21st Century. The apportionment is effective immediately.

  2. AVAILABILITY

    1. The Recreational Trails funds resulting from this apportionment are subject to lapse on September 30, 2002, if they have not been obligated for projects.

    2. The funds resulting from this apportionment are available for obligation immediately and will be subject to obligation controls in force at the time of obligation.

    3. The participating rate for these funds is 80 percent subject to the provisions of section 206(f) of Title 23, United States Code. The State Administrative costs are 80 percent and sliding scale rates not to exceed 95 percent.

    4. The appropriation code is Q94.

  3. ACTION. Division Administrators should ensure that copies of this Notice are furnished to State Transportation Agencies.

CERTIFICATE OF APPORTIONMENT OF
THE SUM OF $40,000,000 AUTHORIZED TO BE APPROPRIATED FOR
THE RECREATIONAL TRAILS PROGRAM
FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1999

TO--

The Secretary of the Treasury of the United States and the State Agencies responsible for the Recreational Trails Program:

Pursuant to section 9503 of the Internal Revenue Code of 1986, the Transportation Equity Act for the 21st Century, title 23, United States Code, and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator in section 1.48, title 49, Code of Federal Regulations, I certify--

First, that the Secretary of the Treasury has made the estimate required by section 9503(d) of the Internal Revenue Code of 1986 and based on that estimate, I have determined that the amount which can be apportioned for the Recreational Trails Program for the fiscal year ending September 30, 1999, is, $40,000,000 which is 100 percent of the amount authorized to be appropriated for the Program for that fiscal year pursuant to section 1101(a)(7) of the Transportation Equity Act for the 21st Century.

Second, that in compliance with section 104(h)(1) of title 23, United States Code, I have estimated that it will be necessary for administering the provisions of section 206 of title 23, United States Code, to deduct 1.50 percent from the amount authorized to be appropriated for the fiscal year ending September 30, 1999, for the Recreational Trails Program and I have deducted said 1.50 percent from the sum of $40,000,000 authorized to be appropriated for fiscal year ending September 30, 1999, by section 1101(7) of the Transportation Equity Act for the 21st Century.

Third, that after making the deduction, I have computed the apportionment among the several States and the District of Columbia of the remainder of the amounts authorized to be appropriated for the Recreational Trails Program in the manner provided by law in accordance with the formula set forth in section 206 of title 23, United States Code.

Fourth, that subject to the foregoing deduction, the sums which are hereby apportioned to each State and the District of Columbia, effective immediately are respectively as follows:
