By Mr. Willett's October 3 memorandum, you were provided interim guidance relative to the May 17 District of Columbia Court of Appeals Midway Decision. Enclosed for your use is supplemental information developed to further clarify the application of Davis-Bacon requirements to truck drivers pursuant to Midway and FHWA's interim policy for implementation. This information has been prepared in response to inquiries made by various field offices since the Midway ruling was issued.
