Transportation Conformity Rulemakings

March 14, 2012 Transportation Conformity Rule Restructuring Amendments; Final Rule - Federal Register, Vol. 77, No. 50, page 14979, March 14, 2012. EPA promulgated revisions to the transportation conformity rule to restructure several sections of the rule so that they apply to any anew or revised NAAQS. EPA did not take final action on the proposal that areas analyze a near-term analysis year when using the budget test.
February 27, 2012 Transportation Conformity Rule: MOVES Regional Grace Period Extension; Final Rule - Federal Register, Vol. 77, No. 38, page 11394, February 27, 2012. EPA promulgated a revision to the transportation conformity rule to extend the grace period before MOVES is required for regional emissions analyses for transportation conformity determinations by one year (March 2, 1013).
October 13, 2011 Transportation Conformity Rule: MOVES Regional Grace Period Extension; Proposed Rule - Federal Register, Vol. 76, No. 198, October 13, 2011. EPA proposed to extend the grace period by one year before MOVES is required for regional emissions analyses for transportation conformity determinations (March 2, 2013).
August 13,2010 Transportation Conformity Rule Restructuring Amendments; Proposed Rule - Federal Register, Vol. 75, No. 156, August 13, 2010. EPA proposed to restructure several sections of the transportation conformity so they would apply to any new or revised NAAQS. EPA also proposed that a near-term year would have to be analyzed when using the budget test when an area’s attainment date has passed or has not been established.
March 24, 2010 Transportation Conformity Rule PM2.5 and PM10 Amendments; Final Rule - Federal Register, Vol. 75, No. 56, page 14260, March 24, 2010. EPA promulgated revisions to the transportation conformity rule to address the 2006 24-hour PM2.5 NAAQS, revocation of the annual PM10 NAAQS, and a court remand concerning hot-spot analyses in PM2.5, PM10 and CO areas.
May 15, 2009 Transportation Conformity Rule PM2.5 and PM10 Amendments; Proposed Rule - Federal Register, Vol. 74, No. 93, page 23024, May 15, 2009. EPA proposed to amend the transportation conformity rule to address the 2006 24-hour PM2.5 NAAQS, revocation of the annual PM10 NAAQS, and a court remand concerning hot-spot analyses in PM2.5, PM10 and CO areas.
January 24, 2008 Transportation Conformity Rule Amendments to Implement Provisions Continued in the 2005 Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU); Final Rule - Federal Register, Vol. 73, No. 16, page 4419, January 24, 2008. EPA promulgated revisions to the transportation conformity rule to make it consistent with Clean Air Act section 176(c) as amended by SAFETEA-LU.
May 2, 2007 Transportation Conformity Rule Amendments to Implement Provisions Contained in the 2005 Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU); Proposed rule - Federal Register, Vol. 72, No. 84, page 24472, May 2, 2007. EPA proposed to amend the transportation conformity rule to make it consistent with Clean Air Act section 176(c) as amended by SAFETEA-LU.
March 10, 2006 PM2.5 and PM10 Hot-Spot Analyses in Project-Level Transportation Conformity Determinations for the New PM2.5 and Existing PM10 National Ambient Air Quality Standards - Federal Register, Vol. 71, No. 47, page 12468, March 10, 2006. EPA promulgated revisions to the transportation conformity rule establishing criteria for determining which transportation projects must be analyzed for local particle emissions impacts in PM2.5 and PM10 nonattainment and maintenance areas. May 6, 2005 Transportation Conformity Rule Amendments for the New PM2.5 National Ambient Air Quality Standard: PM2.5 Precursors - Federal Register, Vol. 70, No. 87, page 24280, May 6, 2006. EPA promulgated revisions to the transportation conformity rule for the consideration of PM2.5 precursors in conformity determinations.
December 13, 2004 Options for PM2.5 and PM10 Hot-Spot Analyses in the Transportation Conformity Rule Amendments for the New PM2.5 and Existing PM10 National Ambient Air Quality Standards; Supplemental Notice of Proposed Rule - Federal Register, Vol. 69, No. 238, page 72140, December 13, 2004. EPA requested further comment and proposed additional options to amend the transportation conformity rule regarding the consideration of localized PM2.5 and PM10 emissions impacts of individual transportation projects.

EPA promulgated revisions to the transportation conformity rule to include criteria and procedures for the new 8-hour ozone and fine particulate matter (PM2.5) national ambient air quality standards, and to address a March 2, 1999 court decision. NOTE:On October 20, 2006, the DC Circuit U.S. Court of Appeals vacated 40 CFR 93.109(e)(2)(v). 8-hour ozone areas that do not have adequate or approved 8-hour budgets can no longer utilize this provision to use the interim emissions tests instead of their 1-hour budgets to demonstrate conformity. EPA promulgated two minor revisions to the transportation conformity rule.
October 5, 2001 Transportation Conformity Amendments: Minor Revision of 18-Month Requirement for Initial SIP Submissions and Addition of Grace Period for Newly Designated Nonattainment Areas; Proposed Rule - Federal Register, Vol. 66, No. 194, page 50954, October 5, 2001. EPA proposed two minor revisions to the transportation conformity rule.
April 10, 2000 Transportation Conformity Amendment: Deletion of Grace Period; Final Rule - Federal Register, Vol. 65, No. 69, page 18911, April 10, 2000. EPA eliminated a provision of the transportation conformity rule that was overturned by court decision.
November 30, 1999 Transportation Conformity Amendment: Deletion of Grace Period; Proposed Rule - Federal Register, Vol. 64, No. 229, page 66832, November 30, 1999. EPA proposed to delete a provision of the transportation conformity rule that was overturned by court decision.
March 18, 1999 Transportation ConformityRule Amendment for the Transportation Conformity Pilot Program; Final Rule - Federal Register, Vol. 64, No. 52, page 13476, March 18, 1999. EPA finalized the amendment to the transportation conformity rule which allows EPA to create and implement a conformity pilot program.
