Subject: INFORMATION: Guidance for Department of Labor Semi-annual Enforcement Reports Date: April 13, 1998

The Federal Highway Administration (FHWA), pursuant to 29 CFR 5.7(b), is required to furnish the Department of Labor (DOL) with semi-annual reports on compliance with and enforcement of the Davis-Bacon and Related Acts. The FHWA has developed FHWA Form 1494 for this purpose. The DOL recently revised its reporting procedures to require information concerning back wages paid. This is reflected in items 8(a) and (b)on FHWA 1494. A copy of this form is attached. In an attempt to meet DOL's revised requirements and streamline the manner in which these reports are developed and transmitted, we have worked with DOL and are modifying our process.

Starting with the October 1, 1997 through March 31, 1998, reporting period a modified process will be utilized. The process has been modified such that the report or information included in the report will be sent directly from the divisions to the DOL. The divisions have the option, if desired, to allow the State departments of transportation to forward the report to the DOL. A copy of the report shall be maintained at the division office. No additional transmittals to the regional office or Headquarters are necessary.

The Form, FHWA-1494, has been modified and continues to be available via Informs and FHWA's Intranet. Paper transmittals utilizing this form shall be sent to the following address.

The DOL will also accept electronic transmittals. The information contained in the report may be electronically submitted to: emp@fenix2.dol-esa.gov.

The attached reporting format may be utilized for electronic transmittals. A paper copy is not required when utilizing the electronic transmittal.

The reports are due within 30 days of the end of the reporting period.
