The purpose of this memorandum is to update and revise our April 13, 1998 memorandum on this subject. The Federal Highway Administration (FHWA), pursuant to 29 CFR 5.7(b), is required to furnish the Department of Labor (DOL) with semi-annual reports on compliance with and enforcement of the Davis-Bacon and Related Acts. The FHWA has developed FHWA Form 1494 for this purpose. The DOL recently revised its addresses for paper and electronic submittals of semi-annual reports. FHWA Form 1494 has been revised to reflect these changes.

The reporting process in place since 1998 remains unchanged. The report or information included in the report will be sent directly from the Divisions to the DOL. The Divisions have the option, if desired, to allow the State departments of transportation to forward the report to the DOL. A copy of the report shall be maintained at the Division office. No additional transmittals to the Headquarters office are necessary.

The form FHWA 1494, has been modified and continues to be available via FHWA Staffnet. Paper transmittals utilizing this form shall be sent to the following address.

The DOL accepts electronic submittals of the compliance reports in lieu of paper copies at this address: SemiAnnualReport@DOL.gov.
