Re: SEP -16 LOI (Letter of Interest) Request for Waiver of FHWA Reviews and Approvals on Disposal of Property; on Disposal of Access Control; and on Property Leases ( on NHS/or off NHS) when the disposal or lease is at Fair Market Value or within 15% below Fair Market Value

Under FHWA established Special Experiment Project (SEP-16) authority granted in 23 USC 156 and CFR 710.409 for the disposal of prope1ty, access control and property leases, GDOT is submitting a Letter of Interest to bring our federal property transactions into alignment and consistency with our current state property transactions under Georgia state codes. The Depmtment is regulated under current Georgia State Code Titles 32-7-4 (Procedure for disposition of property) and 32-7-5 (Leasing property not needed for public road purposes). These two Georgia codes allow GDOT and the Local Governments the flexibility to dispose of property or certain approved portions of limited access rights at Fair Market Value (FMV) or up to within 15% below FMV and to lease property at FMV or up to within 15% below FMV.

GDOT is seeking this waiver to take advantage of the SEP-16 process for the program level approval of the property disposal within the requirements of the state law.
