SUBJECT: Application for Letter of Consent (LOC), Deed for Permanent ROW, Temporary Construction Easement Deed, Hoback-Jackson, Snake River South, Project No. N104066, Teton County, Wyoming

Dear Ms. O'Connor:

In the enclosed March 15, 2018 letter, the Transportation Commission of Wyoming has applied for a Letter of Consent (LOC) to transfer federally controlled public lands under the jurisdiction of the Forest Service, Department of Agriculture, with the provisions of Section 317, Title 23, Code (Highways) approved August 27, 1958, (72 Stat. 885), and nondiscrimination assurance according to Title VI, Civil Rights Act 1964. This is for the Bridger-Teton Forest portion of the corridor.

The applied for permanent right-of-way totals 1.22 acres and is described in the enclosure documents as:

Sixth Principal Meridian, Teton County, Wyoming
T. 39 N., R.116W
Gov't Lots 3 & 9 of Section 11, NE1/4SW1/4;

The applied for temporary right-of-way totals 3.97 acres and is described in the enclosure documents as:

Sixth Principal Meridian, Teton County, Wyoming
T. 39N., R.116W
Gov't Lots 3 & 9, Section 11, NE1/4SW1/4; and Section 23, NE1/4NW1/4;

The State's application letter includes a statement of compliance with the National Environmental Policy Act (42 U.S.C. 4332), the National Historic Preservation Act (16 U.S.C. 470), and the Preservation of Parklands Act (23 U.S.C. 138) during the planning of the project.

Accompanying this application is a copy of the following:

  1. Plan and Profile Sheets showing permanent and temporary areas (Exhibit A);
  2. Topographic Map showing permanent and temporary areas (Exhibit B);
  3. Parcel Summary showing acreage of permanent and temporary areas (Exhibit C); and
  4. Copies of the Final Environmental Impact Statement (FEIS) and Record of Decision environmental documents (Compact Disk).

FHWA concurs in the need for the transfer and requests this application be given appropriate priority, in accordance with the provisions of 23 U.S.C. 317, and 23 CFR 710.601. Deeds for conveyance of lands or interests in lands owned by the United States shall be prepared by WYDOT upon completion of construction.
