In addition, the State's application letter includes a statement of compliance with the National Environmental Policy Act, the National Historic Preservation Act, and the Preservation of Parklands, as applicable, during the planning of the project.
The State's letter informs us that the surface rights are to be obtained, reserving unto the grantors all minerals of every kind and nature that can be removed from the ground without jeopardy to the maintenance or safety of public travel upon the surface estate and without using the surface of the lands granted.
