Dear Commissioner McMurry:

This letter is in response to your April 23, 2019 letter of interest to participate in the Federal Highway Administration's (FHWA's) Special Experimental Project (SEP-16) requesting the delegation of responsibility for applying the 23 USC Section 156 "Social, Economic, and Environmental" exceptions to fair market value, and issue approvals on those waivers on a case-by-case basis on behalf of the FHWA.

We have completed our review of your proposal, and are inviting you to proceed with submitting a Concept Paper. As described in the FHWA's June 24, 2020, Federal Register Notice expanding the SEP-16 program to include project-level actions, the Concept Paper should be a document detailing the specifics of your proposal, including the laws, controls and resources that the Georgia Department of Transportation (GDOT) has in place to support the experimental delegation of specific FHWA responsibilities. Please contact Steve Luxenberg to arrange an initial meeting, during which the particular topics that need to be addressed in the Concept Paper will be discussed.
