Summary:

The Federal Highway Administration (FHWA) is seeking comments on whether a waiver of the Buy America requirements under 23 CFR § 635.410(b) should be granted to permit the use of non-domestic parts for the construction of two pedestrian elevators or let-down structures needed for a pedestrian bridge associated with the I-74 Mississippi River Bridge project in Bettendorf, Iowa. The non-domestic parts include: (i) traction elevator components; (ii) elevator guide rails; and (iii) additional auxiliary components of the two elevators or let-down structures.

The FHWA will only consider a Buy America waiver when the conditions of 23 CFR § 635.410(c) have been met. This includes: (1) when the application of the requirements under § 635.410(c) would be inconsistent with the public interest; or (2) when steel and iron products are not produced in the United States in sufficient and reasonably available quantities, which are of a satisfactory quality.

Background on the I-74 Mississippi River Bridge Project and Waiver Request: The City of Bettendorf, Iowa, through the Iowa Department of Transportation (Iowa DOT), is seeking a Buy America waiver for pedestrian elevators or let-down structures needed for a pedestrian bridge associated with the I-74 Mississippi River Bridge project in Bettendorf, Iowa. The waiver request is for procurement of foreign iron and steel components for construction of the two elevators, specifically including: (i) traction elevator components; (ii) elevator guide rails; and (iii) additional auxiliary components of the two elevators or let-down structures.

The two elevators are part of the approximately $1.2 billion I-74 Mississippi River Bridge reconstruction project. The elevators are needed to meet accessibility requirements under the Americans with Disabilities Act, 42 U.S.C. § 12101, et seq., for a new pedestrian bridge. The elevators also provide additional safety for pedestrians and bicyclists. The pedestrian bridge and elevators will provide links to both the Illinois and Iowa river trail network.

The Pedestrian Bridge and elevators are included under an approximately $2.2 million contract. The City originally estimated that the elevators would cost approximately $427,000. This contract is 100 percent funded by the City of Bettendorf, Iowa, with no Federal funding. However, the pedestrian bridge and structures connecting the bridge to the trail network were included under the final environmental impact statement and record for the overall I-74 Mississippi River Bridge project. Therefore, under 23 U.S.C. § 313(g), FHWA’s Buy America provision applies to the contract and letdown structure. All other contracts associated with the approximately $1.2 billion project are expected to comply with Buy America requirements.

Waiver request and subsequent communications with FHWA: The Iowa DOT originally submitted a Buy America waiver request letter to FHWA for certain components of the elevators in March 2020. Prior to requesting a waiver, the City of Bettendorf unsuccessfully attempted to identify domestic manufacturers for these products. The Iowa DOT reported to FHWA in the waiver request letter that the City contacted 11 U.S. elevator manufacturers, but none of them could produce elevators meeting the needs of the project using only U.S. steel. The March 2020 request letter sought a waiver for traction elevator components and elevator guide rails.

The elevators identified by Iowa DOT and the City as meeting the needs of the project are produced by KONE Oyj, a company with headquarters in Finland, but also with operations and facilities in the U.S. Iowa DOT identifies the elevators as two Monospace 500 model elevators with glass rear walls.

Consistent with Executive Order 13788, after receiving the waiver request, in April 2020 FHWA requested that the Iowa DOT and City of Bettendorf answer questions about their previous search for Buy America compliant products. FHWA also requested that they continue seeking to maximize the use of goods, products, and materials produced in the U.S. on the project. In response to this request and later follow-up questions from FHWA, the City of Bettendorf attempted over several additional months to identify domestic manufacturers that it had not identified in its original search, or, if full compliance was not possible, foreign manufacturers that could maximize use of domestic content by using greater quantities of U.S. steel. These additional search activities continued between April and August of 2020, but the City did not identify compliant products.

In August 2020, Iowa DOT responded to FHWA’s questions. It explained that none of the manufacturers Iowa DOT or the City of Bettendorf contacted could satisfy Buy America requirements. It also explained that none of the manufacturers could provide reliable certifications of domestic content percentages (to show maximization of domestic content). After completing its additional research, Iowa DOT expanded its waiver request to include certain additional components of the elevator letdown structures. Iowa DOT explained that it could not find a manufacturer to meet Buy America requirements for additional auxiliary “components [in the elevator letdown structures], such as mechanical air handling equipment.” The contacted manufactures explained that they were unable to verify origin of source of materials to satisfy FHWA’s Buy America requirements. Iowa DOT explained that these components are not frequently used in highway construction projects. Instead, they are predominantly used for commercial applications around the world in which material certifications and Buy America requirements are not applicable.

The August 2020 letter from Iowa also explained that KONE Oyj was asked to review the potential for assembling non-standard elevators that would have a greater domestic steel and iron content to meet Buy America requirements. KONE provided an alternative design, but could still neither meet the Buy America requirements nor guarantee or certify the precise amount of domestic content. Moreover, the alternative design provided by KONE would not meet project requirements in terms of size, capacity, or safety. Regarding safety, elevators designed with unique, customized parts would be more difficult to maintain, which could impact the safety and reliability of their operation.

Iowa DOT’s August 2020 letter also addressed alternative designs that were considered such as rack and pinion elevators. Iowa DOT explained that rack-and-pinion elevators, which are used primarily as freight elevators, were not suitable to the elevator’s intended purpose of passenger transport. Moreover, adding structural elements to the project design to support rack-and-pinion elevators could increase project costs by $2 million. It did not consider this cost increase feasible. An alternative design would also result in significant delays for the project. The I-74 Mississippi River Bridge is currently scheduled to open to Iowa-bound vehicle traffic by the end of 2020 and to Illinois-bound vehicle traffic before the end of 2021. Iowa DOT also reported that other alternative designs were considered, but also could not fully comply with Buy America requirements for all components and would result in significantly higher construction costs and lengthy project redesign. Thus, Iowa DOT did not find justification for pursuing the alternative designs.

Iowa DOT also explained the current fiscal situation in the City of Bettendorf in the August 2020 letter. It explained that COVID-19 has caused financial hardship for the City and that any additional costs associated with Buy America compliance, such as completely redesigning the elevators or adding structural components, would impact the city’s ability to complete the project and fund necessary services.

In October 2020, FHWA again contacted Iowa DOT with additional questions regarding its efforts to comply with Buy America and Executive Order 13788. FHWA also sought clarity on the scope of waiver the request. Later that month, Iowa DOT provided answers to FHWA’s questions with additional information on its compliance efforts and a cost estimate sheet identifying all items for which it seeks a waiver (Exhibit D). A link to Exhibit D is provided below. All items included in the waiver request are identified as not meeting Buy America in the first column of Exhibit D. The estimated total cost of the waiver items is approximately $768,000. FHWA removed the cost estimates for individual line items in Exhibit D to maintain the confidentiality of the City’s procurement-sensitive information during its solicitation process.

The FHWA seeks comments on whether a waiver of the Buy America requirements under 23 CFR § 635.410(b) should be granted to Iowa DOT and the City of Bettendorf for: (i) traction elevator components; (ii) elevator guide rails; and (iii) additional auxiliary components of the two elevators or let-down structures identified in Exhibit D. In addition to comments on the availability of compliant products, the FHWA seeks comments on whether the City of Bettendorf, given its circumstances, has taken sufficient actions to maximize its use of goods, products, and materials produced in the United States.

The FHWA will consider all comments received in the initial 15-day comment period during our evaluation of the waiver request. Comments received after this period, but before notice of our finding is published in the Federal Register, will be considered to the extent practicable. Follow-up coordination on the comments received may result in a delay in the publication of our waiver finding in the Federal Register. Comments received during the 5-day comment period after notice of our finding is published in the Federal Register will be reviewed, but the finding will continue to remain valid. Comments received during the comment period after the effective date of the finding may influence the FHWA’s decision to terminate or modify a finding.

I believe that our country has failed in the fact that we have let so many companies be dependant on products from foreign countries. We should be more self sufficient but with the cheaper alternatives outside of our country we've gotten lazy and then use their factories which in turn help out their communities and not benefit our own American Citizens at all. Which has made foreign entities way more advanced in production of the materials needed for this project. To complete for the safety of the public and cost of the project, I would agree to sign the waiver to use outside sources of the made in america products. WE did it to ourselves, it's time to get our country back on our own feet and grow!! This is a perfect example and sign of the times to bring it home people! WE need to make America Great Again.!!

I would 1st check dominant spec on elevator components based on their corresponding metallurgical requirements and then compare with what was submitted. Obtain ALL certification documentation from suppliers and determine if ALL standard testing has been sufficed.if questionable, have City provide this documentation. Otherwise, I would leave liability with the City and have the State DOT requesting a license agreement for the life of the use of that elevator and components, maintenance, operations,etc. My experience, if you can't produce steel/iron components according to MINIMUM industry specs, I would question this.

The City of Bettendorf supports the waiver, which is pending with the Federal Highway Administration. The I-74 Bridge elevator will provide pedestrians and bicyclists direct and easy access to the trail that connects Bettendorf�s riverfront to Moline�s downtown area. The multiuse trail is one of only a few on an interstate highway in the nation. The I-74 Mississippi River Bridge historically has provided an important east-west link in the nation's transportation network. The new bridge will continue the connectivity with the Mississippi River, the Quad Cities, and the rest of the country. When the I-74 Bridge project is completed, we will have a state of the art bridge that most certainly will be a destination point for our residents and visitors from around the world. Thank you.

Due diligence has been completed in attempting to meet the Buy America requirements. As mentioned in the explanation, this is a unique aspect of this project including an elevator in the project. An elevator is needed in this location. Having a multiuse trail over the river is important to connect all these river communities. I support the waiver and applaud the efforts of the city to meet the requirements of Buy America.

The Quad Cities Chamber of Commerce supports the waiver pending with the Federal Highway Administration. While the Chamber endorses buying local and supporting local vendors whenever possible, it is clear the City of Bettendorf has exhausted all domestic options for supplies related to the elevator/letdown component on the I-74 bridge project. The I-74 Bridge elevators will be an inclusive and accessible design element that will provide safe and direct passage onto the I-74 bridge's pedestrian trail for all Quad Citizens and visitors. In addition to safe passage across the river, pedestrians and cyclists will also enjoy access to the Mississippi River Trail and the American Discovery Trails in Illinois and Iowa. This portion of the overall project will serve to further connect our residents and communities, and we look forward to the entire project's completion as a milestone for our region.

The Louisiana Dept. of Transportation and Development (La DOTD) Bridge Design Section supports this waiver request. In a case like this, it is important to remember the purpose of the Buy America Act, which is to support America's domestic steel industry because it is considered vital in relation to national security. This project, and the many other transportation projects around the country, purchase many millions (billions?) of dollars of structural steel annually. It will all be domestically sourced because of the Buy America Act, and it is these purchases that will insure the present and future success of the American steel industry. The steel used in this elevator will not. Forcing the Iowa DOT to provide an elevator in which all the steel is verified to be domestically produced will result in an elevator of unusually high cost and inferior quality (if it can be acquired at all) compared to the one commercially available from a non-domestic source. This would be "inconsistent with the public interest", which is a reason specifically listed in the Buy America Act as justification for a waiver.

The cost of these elevator components is so small in comparison with the full project, which complies with Buy America, that for this specialized purpose, a waiver should be issued. Creating one of the few ways for pedestians to cross the Mississippi that is ADA accessible is paramount to this relatively small purchase outside our borders.

With the pedestrian component everyone will have the opportunity to see the size, force & beauty of this storied river. After thoroughly reading the request and all comments submitted up to this point I am supportive of this waiver request. I am thankful for the Buy America Act, and understand the circumstances for which this aspect of the project could not fulfill the requirements. I appreciate the lengths to which the City of Bettendorf has gone in attempt to meet the Buy America requirements. I do hope for more and more projects to meet the Buy America Act and the need for waivers decreases over time. Looking forward to the completion of this bridge in its fullest extent.

After reading the entire request, it appears that the City of Bettendorf has done due diligence in attempting to comply with Buy America requirements on this essential project for the benefit of the entire Quad Cities. As also mentioned by others, the construction of an elevator is both unusual for highway projects and a very small portion of the overall project. Therefore, I support the Buy America act waiver for the pedestrian/cyclist elevator.

This is a clear case of full compliance with the Buy America Act being in conflict with the public interest of providing an Accessible route for pedestrians. It is clear from the Summary stating that providing an Accessible route by elevator for pedestrians is not feasible with products currently available. This would appear to meet the waiver requirements of § 635.410(c).

To have this small, but so important, component of this large transportation project delayed because of the steel not currently available would be dismal. According to the 2015-2019 U.S. Census estimate, 7.6% of people live in Scott County and 9% of people live in Rock Island County �with a disability, under age 65 years�. The Quad Cities must offer elevator access to the I-74 bridge as a commitment to advancing equity for all individuals and communities. Everyone deserve the opportunity for outdoor physical activity opportunities and breathtaking views of the mighty Mississippi River. I urge you to approve the Buy American Act waiver to improve the health, safety, and welfare of Quad Citizens by enhancing this iconic pathway to increase physical activity opportunities where we live, work, learn, and play.

To deny people in our community access to the simple privilege of taking an outdoor stroll for the purpose of living up to some ridiculous made up standard is morally repugnant. Providing access to safe travel and healthy recreation for ALL community members should not be a debate to have in a modern civil society. Build the elevator in the most cost effective and safe way possible, and stop ignoring and placing undue burden on people who already have additional life struggles.

Getting this elevator in place for ADA access and for the safe use of the bridge by pedestrians and bicyclists alike is vital. Delaying access because some Made In America parts are simply not available will not help the local community or industry. I support the waiver in the interest of a vital link between the Iowa and Illinois sides of the River and in the interests of local pedestrians, cyclists and Americans living with Disabilities.

While I strongly believe in buying American-made whenever possible, in this case, the specific components needed to build the safest, most reliable elevator are not available at this time. As a cyclist and member of the Quad Cities Bicycle Club, I have to admit that most, if not all, of the bicycles we ride are assembled with components that are made in Japan or other countries, even if the bike is made in America by an American company. It would be hypocritical to demand that the elevator that connects the trails we ride on are 100% made in America. I applaud Bettendorf's efforts to meet the requirements, and in the interest of time and safety, I support the waiver.

The cost of this elevator relative to the total cost of the project is minuscule. The active transportation & mobility benefits provided by the bridge & elevator will be tremendous. Even if it were feasible, a custom design using non-standard parts would significantly increase ongoing maintenance costs (our Tax $$) and lengthen downtime for repairs. I support the Buy America Act but oftentimes you just can't get the parts or materials you need from a domestic source. I design equipment for the US military and we frequently have difficulty finding certified domestic suppliers particularly for commodities. Our domestic industrial base atrophied over many decades due to lack of investment, cost cutting and globalization (among other things). Many measures to address this were, unfortunately, akin to closing the barn door after the horses are out. We have to work in the world as it is not as we wish it to be. I support granting the waiver.

As a long time cyclist I have long looked forward to cycling across the I-74 bridge. However, it's not just cyclists to be considered. Those who are handicapped or other wise unable should have the thrill of looking at the grand Mississippi River from the viewing area of the long awaited for bridge. Considering the small cost of the elevator in relation to the cost of the entire project, I think the waiver should be granted so the elevator acess can be completed. Other countries buy from us and there are times when it is expedient to purchase from other countries. I support the waiver.
